SENATE Concurrent RESOLUTION—Endorsing the creation of business divisions of the district courts in the Second and Eighth Judicial Districts through the adoption of court rules developed by the Business Court Task Force.
1-1 Whereas, The State of Delaware has been recognized for its efficient
1-2 and professional Court of Chancery, which resolves commercial and
1-3 corporate matters and which has earned international prominence in the
1-4 areas of corporate, business and commercial law; and
1-5 Whereas, The creation of business courts modeled after the Court of
1-6 Chancery has proven successful in other states for facilitating the prompt
1-7 and final resolution of disputes, thereby eliminating the delay in litigation
1-8 found in courts of general jurisdiction; and
1-9 Whereas, The limited jurisdiction of such courts promotes greater
1-10 specialization to ensure that disputes are heard by judges with experience
1-11 and expertise in complex commercial and corporate matters; and
1-12 Whereas, The establishment of business courts as divisions of the
1-13 district courts in the Second and Eighth Judicial Districts will contribute to
1-14 the development and stability of corporate and business law, will ensure
1-15 consistency in decisions and expertise in the disposition of complex
1-16 commercial and corporate matters and will make this state a more
1-17 attractive location in which to organize and conduct business; and
1-18 Whereas, The members of the Business Court Task Force have,
1-19 through extensive deliberation and analysis, developed court rules
1-20 providing for the creation of business courts as divisions of the district
1-21 courts in the Second and Eighth Judicial Districts and prescribing their
1-22 jurisdiction and procedures; now, therefore, be it
1-23 Resolved by the Senate of the State of Nevada, the Assembly
1-24 Concurring, That the members of the 71st Session of the Nevada
2-1 Legislature hereby endorse the creation of business courts as divisions of
2-2 the district courts in the Second and Eighth Judicial Districts through the
2-3 adoption of court rules developed by the Business Court Task Force; and
2-4 be it further
2-5 Resolved, That the members of the 71st Session of the Nevada
2-6 Legislature hereby commend the members of the Business Court Task
2-7 Force for their hard work in providing for the creation of business courts;
2-8 and be it further
2-9 Resolved, That the Secretary of the Senate prepare and transmit a copy
2-10 of this resolution to the Chief Justice of the Supreme Court of Nevada, the
2-11 Chief Judge of the Second Judicial District Court and the Chief Judge of
2-12 the Eighth Judicial District Court.
