SUMMARY—Makes appropriations to University of Nevada School of Medicine to conduct study to determine whether there is sufficient demand for heart transplant facility in Southern Nevada. (BDR S‑44)

AN ACT making an appropriation to the University of Nevada School of Medicine for expenses relating to a study to determine whether there is sufficient demand for a heart transplant facility in Southern Nevada; making an appropriation to the Interim Finance Committee for allocation to the University of Nevada School of Medicine for the establishment and operation of the heart transplant facility that is contingent upon the results of the study; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  There is hereby appropriated from the State

1-2  General Fund to the University of Nevada School of Medicine the

1-3  sum of $250,000 for expenses relating to a study to determine

1-4  whether there is sufficient demand for a heart transplant facility in

1-5  Southern Nevada.


2-1  2.  The University of Nevada School of Medicine shall conduct

2-2  the study, which must include, without limitation:

2-3  (a) A determination of whether there is a legitimate need for a

2-4  heart transplant facility in Southern Nevada, based on research

2-5  relating to the number of patients that need heart transplants

2-6  annually and the number of Nevadans who had to travel to other

2-7  states to obtain their transplants;

2-8  (b) The number of patients in Nevada currently in need of a

2-9  heart transplant;

2-10      (c) An examination of the requirements for a heart transplant

2-11  facility set forth by the United Network for Organ Sharing, which is

2-12  the certifying organization for transplant facilities;

2-13      (d) A survey of private entities that have expressed an interest in

2-14  investing in such a facility and an analysis of the possibility of a

2-15  joint venture between the University of Nevada School of Medicine

2-16  and private surgeons and investors; and

2-17      (e) The costs involved in establishing and operating a heart

2-18  transplant facility for the first 2 years.

2-19      3.  The University of Nevada School of Medicine must report

2-20  the results of the study to the Interim Finance Committee for its

2-21  approval before proceeding with the construction or staffing of such

2-22  a facility.

2-23      4.  Any remaining balance of the appropriation made by

2-24  subsection 1 must not be committed for expenditure after June 30,

2-25  2005, and reverts to the State General Fund as soon as all payments

2-26  of money committed have been made.

2-27      Sec. 2.  1.  There is hereby appropriated from the State

2-28  General Fund to the Interim Finance Committee the sum of

2-29  $19,750,000 for allocation to the University of Nevada School of

2-30  Medicine for the establishment and operation of a heart transplant

2-31  facility in Southern Nevada.

2-32      2.  After considering the results of the study performed pursuant

2-33  to section 1 of this act, the Interim Finance Committee shall

2-34  determine whether to allocate all or any portion of the money

2-35  appropriated by subsection 1 on the basis of the need for the facility

2-36  established by the study.

2-37      3.  Any remaining balance of the appropriation made by

2-38  subsection 1 must not be committed for expenditure after June 30,

2-39  2007, and reverts to the State General Fund as soon as all payments

2-40  of money committed have been made.

2-41      Sec. 3.  This act becomes effective on July 1, 2003.
