AN ACT relating to food programs for children; making an appropriation for the reimbursement of certain costs incurred by private nonprofit sponsors of summer food service programs; requiring the Superintendent of Public Instruction to conduct an evaluation of the summer food service programs in this state; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  There is hereby appropriated from the State

1-2  General Fund to the Department of Education the sum of $700,000

1-3  for the reimbursement of certain costs incurred by private nonprofit

1-4  sponsors of summer food service programs.

1-5  2.  On or before December 31, 2003, a private nonprofit

1-6  sponsor of a summer food service program authorized by the

1-7  Department of Education or previously authorized by the

1-8  Department may submit a claim to the Department for

1-9  reimbursement of certain costs incurred in sponsoring the program.

1-10  A claim must not include any amounts that were paid to the sponsor

1-11  by this state or the Federal Government for the support of the

1-12  program. Only a sponsor of a current program or a sponsor of a

1-13  program that operated in the immediately preceding year may


2-1  submit such a claim. The Department shall evaluate the claims

2-2  submitted. Upon the request of the Department, a sponsor shall

2-3  submit any additional information required by the Department to

2-4  verify the accuracy of the claim.

2-5  3.  On or before March 1, 2004, the Department of Education

2-6  shall distribute the money appropriated by subsection 1 to each

2-7  sponsor with an approved claim. To the extent money is available

2-8  from the appropriation, the amount distributed to each sponsor must

2-9  be an amount equal to the actual verified costs incurred by the

2-10  sponsor that were not otherwise reimbursed by this state or the

2-11  Federal Government. If insufficient money is available from

2-12  the appropriation made by subsection 1 to pay the actual verified

2-13  costs of each sponsor, the Department of Education shall distribute

2-14  the money to each sponsor with an approved claim on a pro rata

2-15  basis based upon the number of children served through the program

2-16  by each sponsor.

2-17      Sec. 2.  1.  The Superintendent of Public Instruction shall

2-18  evaluate the summer food service programs operated in this state

2-19  that are authorized by the Department of Education. On or before

2-20  September 15, 2003, the Superintendent of Public Instruction shall

2-21  submit to the Legislative Committee on Education a written report

2-22  of the results of the evaluation that includes, without limitation:

2-23      (a) An assessment of the effectiveness of the summer food

2-24  service programs operated in this state in addressing the nutritional

2-25  needs of children in this state, including, without limitation, whether

2-26  all available resources are used to ensure that Nevada’s children do

2-27  not go hungry;

2-28      (b) Identification of methods to ensure that institutions refrain

2-29  from actions that cause them to be placed on the list of “seriously

2-30  deficient institutions” in accordance with applicable federal law and

2-31  methods to assist such institutions in taking sufficient corrective

2-32  actions to facilitate their removal from that list;

2-33      (c) An assessment of the outreach, training and monitoring

2-34  conducted by the Department of Education for the sponsors of the

2-35  summer food service programs; and

2-36      (d) The feasibility of developing a supplemental food program

2-37  that will identify, train and underwrite local sponsors.

2-38      2.  The Legislative Committee on Education shall review the

2-39  written report submitted pursuant to subsection 1 and, based upon

2-40  its review, take such action as it determines necessary, including,

2-41  without limitation, forwarding a copy of the written report to the

2-42  73rd Session of the Nevada Legislature and making

2-43  recommendations for legislation.

2-44      Sec. 3.  Any remaining balance of the appropriation made by

2-45  section 1 of this act must not be committed for expenditure after


3-1  June 30, 2005, and reverts to the State General Fund as soon as all

3-2  payments of money committed have been made.

3-3  Sec. 4.  This act becomes effective upon passage and approval.
