AN ACT relating to motor vehicles; authorizing the Department of Motor Vehicles to establish a pilot program pursuant to which the period of registration for certain motor vehicles is expanded; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Notwithstanding any specific statute to the
1-2 contrary:
1-3 1. Except as otherwise provided in this section, the Department
1-4 of Motor Vehicles may adopt regulations establishing a pilot
1-5 program pursuant to which motor vehicles, other than motor
1-6 vehicles registered pursuant to the provisions of NRS 706.801 to
1-7 706.861, inclusive, and motor vehicles that have a declared gross
1-8 weight in excess of 26,000 pounds, are registered for a period of 24
1-9 consecutive months.
1-10 2. In establishing a pilot program pursuant to this section, the
1-11 Department of Motor Vehicles shall work in cooperation with:
1-12 (a) The Department of Taxation and the board of county
1-13 commissioners of each county in which the pilot program will be
2-1 carried out concerning the assessment and collection of any taxes
2-2 imposed on motor vehicles participating in the pilot program,
2-3 including, without limitation, the governmental services tax imposed
2-4 pursuant to chapter 371 of NRS; and
2-5 (b) The State Environmental Commission and the local air
2-6 pollution control agency for each county in which the pilot program
2-7 will be carried out concerning the testing of emissions of the motor
2-8 vehicles participating in the pilot program. The State Environmental
2-9 Commission, in consultation with the Department of Motor
2-10 Vehicles, may adopt such regulations as are necessary to provide for
2-11 the testing of emissions of motor vehicles participating in the pilot
2-12 program.
2-13 3. The Department of Motor Vehicles may adopt regulations
2-14 establishing a schedule of fees, including penalties, to be assessed
2-15 on motor vehicles participating in a pilot program that corresponds
2-16 to the fees that would otherwise be assessed on the registration of
2-17 motor vehicles pursuant to chapter 482 of NRS. The amount of any
2-18 fee adopted by regulation pursuant to this subsection for the
2-19 24-consecutive month period of registration must not exceed the
2-20 amount that would be assessed pursuant to its corresponding fee for
2-21 that same period if the motor vehicle was not participating in the
2-22 pilot program.
2-23 Sec. 2. If the Department of Motor Vehicles establishes a pilot
2-24 program pursuant to section 1 of this act, the Department shall
2-25 conduct a study of the pilot program and submit a report of the
2-26 results of the study, together with any recommended legislation, to
2-27 the Director of the Legislative Counsel Bureau on or before
2-28 February 1, 2007, for transmittal to the 74th Regular Session of the
2-29 Legislature.
2-30 Sec. 3. 1. This section and section 2 of this act become
2-31 effective upon passage and approval.
2-32 2. Section 1 of this act becomes effective upon passage and
2-33 approval for the purpose of adopting regulations and on July 1,
2-34 2004, for all other purposes, and expires by limitation on June 30,
2-35 2007.
