Senate Joint RESOLUTION—Proposing to amend the Nevada Constitution to authorize the Legislature to convene at places other than the seat of government and clarifying the time by which the Legislature must adjourn each regular session sine die.

 

1-1  Resolved by the Senate and Assembly of the State of

1-2  Nevada, Jointly, That Section 1 of Article 4 of the Nevada

1-3  Constitution be amended to read as follows:

1-4  Section [.]1.  The Legislative authority of this State shall

1-5  be vested in a Senate and Assembly which shall be designated

1-6  “The Legislature of the State of [Nevada” and the] Nevada.”

1-7  The regular and special sessions of such Legislature shall be

1-8  held at the seat of government of the State[.] unless a

1-9  majority of the Legislature deems it necessary and

1-10  appropriate to hold all or any portion of a regular or special

1-11  session at another place in the State. During a session, the

1-12  Legislature may by concurrent resolution designate another

1-13  place to hold all or any portion of the remainder of that

1-14  session. During the interim between regular sessions, upon

1-15  petition transmitted to the Secretary of State by a majority of

1-16  the members of each House of the Legislature who would

1-17  serve at an upcoming regular or special session, all or any


2-1  portion of the specified session may be held at another place

2-2  in the State designated in the petition. Upon receipt of one

2-3  or more substantially similar petitions, signed in the

2-4  aggregate by a majority of the members of each House of

2-5  the Legislature, the Secretary of State shall notify all

2-6  members of the Legislature and the Governor of the

2-7  alternate location of the upcoming session and the days on

2-8  which the alternate site will be used.

2-9  And be it further,

2-10          Resolved, That Section 2 of Article 4 of the Nevada

2-11  Constitution be amended to read as follows:

2-12     Sec. 2.  1.  The sessions of the Legislature shall be

2-13  biennial, and shall commence on the 1st Monday of February

2-14  following the election of members of the Assembly, unless

2-15  the Governor of the State shall, in the interim, convene the

2-16  Legislature by proclamation.

2-17     2.  The Legislature shall adjourn sine die each regular

2-18  session not later than midnight [Pacific standard time 120

2-19  calendar days following its commencement.] on the 120th

2-20  calendar day of the session. Any legislative action taken

2-21  after midnight [Pacific standard time] on the 120th calendar

2-22  day is void, unless the legislative action is conducted during a

2-23  special session convened by the Governor.

2-24     3.  The Governor shall submit the proposed executive

2-25  budget to the Legislature not later than 14 calendar days

2-26  before the commencement of each regular session.
