The Committee on Transportationwas called to order at 11:30 a.m., on Friday, May 16, 2003, behind the Bar of the Assembly by Chairman Vonne Chowning.

Chairwoman Chowning called the Assembly Committee on Transportation to order.  [A silent roll call was taken.] She opened the meeting on S.B. 356.

 

 

Senate Bill 356 (1st Reprint):  Revises penalty for certain violations concerning vehicles with loads on highways. (BDR 43-1049)

 

Chairwoman Chowning announced that some new information on S.B. 356 had been presented.

 

           


ASSEMBLYWOMAN OHRENSCHALL MOVED TO RECONSIDER S.B. 356.

 

ASSEMBLYMAN CARPENTER SECONDED THE MOTION. 

 

THE MOTION CARRIED WITH ASSEMBLYMAN COLLINS VOTING NO.

 

 

Chairwoman Chowning said the research staff had provided Ms. Ohrenschall with the legal definition of the term “minor violation.”  Chairwoman Chowning asked Assemblywoman Ohrenschall to read the definition of a “minor violation.”  She read, “A minor violation is a violation that does not pose immediate threat of personal injury or damage to property.”

 

Assemblyman Atkinson said he felt more comfortable with the S.B 356 since that definition had been clarified.

 

Chairwoman Chowning said the proposed amendment to S.B. 356 had been changed to make the new fine $120.  A copy of the proposed amendment was handed out to the Committee members (Exhibit A).

 

Assemblyman Collins said he wanted it on the record that he was adamantly opposed to this piece of legislation.

 

           

ASSEMBLYMAN ATKINSON MOVED TO AMEND AND DO PASS S.B. 356.

 

ASSEMBLYMAN CLABORN SECONDED THE MOTION.

 

THE MOTION CARRIED WITH ASSEMBLYMAN COLLINS VOTING NO.

 


Chairwoman Chowning closed the hearing on S.B. 356 and adjourned the meeting at 11:50.
