MINUTES OF THE Floor meeting

of the

Seventy-second Session

May 23, 2003

The Senate Committee on Taxation was called to order by Chairman Mike McGinness, at 4:11 p.m., on Friday, May 23, 2003, on the Senate Floor of the Legislative Building, Carson City, Nevada. There was no Agenda. There was no Attendance Roster.

COMMITTEE MEMBERS PRESENT:

Senator Mike McGinness, Chairman

Senator Dean A. Rhoads, Vice Chairman

Senator Bob Coffin

Senator Ann O'Connell

Senator Sandra Tiffany

Senator Randolph  J. Townsend

COMMITTEE MEMBERS ABSENT:

Senator Joseph Neal (Excused)

STAFF MEMBERS PRESENT:

Mavis Scarff, Committee Secretary

Chairman McGinness requested the committee consider whether to concur or not concur on two Senate bills, Senate Bill (S.B.) 440 and S.B. Bill 469.

SENATE BILL 440 (2nd Reprint): Provides for postponement of payment of property taxes in cases of severe economic hardship under certain circumstances.  (BDR 32-658)

Chairman McGinness explained in the original bill the assessor was required to take action, and since the treasurer is the entity responsible for the collection of property taxes, it is more appropriate for the treasurer to perform these duties. He recommended the committee concur with Amendment No. 752 to S.B. 440.

SENATOR O’CONNELL MOVED TO CONCUR WITH AMENDMENT NO. 752 TO S.B. 440.

SENATOR TOWNSEND SECONDED THE MOTION.

THE MOTION PASSED. (SENATOR NEAL WAS ABSENT FOR THE VOTE.)

*****

SENATE BILL 469 (1ST REPRINT): Revises formula for distribution of certain revenues among local governments.  (BDR 32-624)

Chairman McGinness explained that Amendment No. 640 to S.B. 469 makes technical adjustments to the consolidated tax districts formula as recommended by the tax distribution committee. He said after last session the Department of Taxation discovered the current provisions and the amended provisions of the formula were not consistent with the manner in which the formula was being administered by the department.  The amendment, he said, fixes the current statutory language as well as the new language that was added to the formula making it consistent with the changes to the current language.

SENATOR O’CONNELL MOVED TO CONCUR WITH AMENDMENT NO. 640 TO S.B. 469.

SENATOR TOWNSEND SECONDED THE MOTION.

THE MOTION PASSED. (SENATOR NEAL WAS ABSENT FOR THE VOTE.)
