AN ACT relating to prescriptions; revising the authority of a practitioner to specify on the label or other device for a drug or medicine an expiration date that is earlier than the expiration date specified by the manufacturer of the drug or medicine under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 639.2801 is hereby amended to read as

1-2  follows:

1-3  639.2801  Unless specified to the contrary in writing on the

1-4  prescription by the prescribing practitioner, all prescriptions filled

1-5  by any practitioner must be dispensed in a container to which is

1-6  affixed a label or other device which clearly shows:

1-7  1.  The date.

1-8  2.  The name, address and prescription serial number of the

1-9  practitioner who filled the prescription.

1-10      3.  The names of the prescribing practitioner and of the person

1-11  for whom prescribed.

1-12      4.  The number of dosage units.

1-13      5.  Specific directions for use given by the prescribing

1-14  practitioner.

2-1  6.  [The] Except as otherwise provided in this subsection, the

2-2  expiration date of the effectiveness of the drug or medicine

2-3  dispensed, if that information is required to be included on the

2-4  original label of the manufacturer of [that] the drug or medicine. [If

2-5  the] The practitioner may specify on the label or other device for

2-6  the drug or medicine an expiration date that is earlier than the

2-7  expiration date specified by the manufacturer [is not less than 1

2-8  year from the date of dispensing,] on the original label if, as

2-9  determined by the practitioner [may use 1 year from the date of

2-10  dispensing as the] , an earlier expiration date[.] is required to

2-11  ensure the safe use of the drug or medicine.

2-12      7.  The proprietary or generic name of the drug or medicine as

2-13  written by the prescribing practitioner.

2-14      8.  The strength of the drug or medicine.

2-15  The label must contain the warning:

 

2-16      Caution: Do not use with alcohol or nonprescribed drugs

2-17  without consulting the prescribing practitioner.

 

2-18      Sec. 2.  This act becomes effective on July 1, 2003.
