AN ACT relating to pupils; requiring the boards of trustees of school districts to adopt policies concerning the use and possession by pupils of pagers, cellular telephones and other similar electronic devices while on the premises of a public school or while at an activity sponsored by a public school; repealing the prohibition against pupils carrying or possessing any electronic device used for paging or communication while on school grounds; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
Section 1. Chapter 392 of NRS is hereby amended by adding thereto a new section to read as follows:
1. The board of trustees of each school district shall adopt a policy concerning the use and possession by pupils of a pager, cellular telephone or any other similar electronic device used for communication while on the premises of a public school or while at an activity sponsored by a public school.
2. The policy adopted pursuant to subsection 1 must:
(a) Prescribe appropriate measures for disciplining a pupil who violates the policy.
(b) Be included within each copy of the rules of behavior for
pupils that the school district provides to pupils pursuant to
NRS 392.463.
Sec. 2. The board of trustees of each school district shall adopt a policy required by section 1 of this act on or before September 1, 2003.
1-1 Sec. 3. NRS 392.930 is hereby repealed.
1-2 Sec. 4. This act becomes effective on July 1, 2003.
1-3 TEXT OF REPEALED SECTION
1-4 392.930 Carrying or possessing on school grounds
1-5 electronic device for paging or communication; exceptions.
1-6 1. Except as otherwise provided in subsection 2, it is unlawful
1-7 for a pupil in kindergarten or grades 1 to 12, inclusive, while on
1-8 school grounds, to carry or possess a beeper, portable telephone or
1-9 any other similar electronic device designed to page or contact a
1-10 person.
1-11 2. A pupil may carry or possess a beeper, portable telephone or
1-12 other similar device on school grounds if he is expressly authorized
1-13 in writing to do so by the school administrator.
1-14 3. As used in this section, “beeper” means a portable electronic
1-15 device which is used to page the person carrying it by emitting an
1-16 audible or a vibrating signal when the device receives a special radio
1-17 signal.
