AN ACT relating to professions; requiring the State Board of Professional Engineers and Land Surveyors to submit annual reports regarding certain activities of the Board to the Director of the Legislative Counsel Bureau; revising the membership of the Board; requiring the Board to hold an examination for an applicant for a license under certain circumstances; requiring the Board to provide its authorized design for a stamp to a retailer or manufacturer under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 625 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  On or before February 1 of each year, the Board shall

1-4  submit a report to the Director of the Legislative Counsel Bureau

1-5  for distribution to each member of the Senate Standing Committee

1-6  on Commerce and Labor and the Assembly Standing Committee

1-7  on Commerce and Labor.


2-1  2.  Each report submitted pursuant to subsection 1 must

2-2  include the following information for the previous calendar year:

2-3  (a) The number of persons who relied upon the provisions of

2-4  this chapter relating to education to qualify for the issuance of a

2-5  license, the results of each examination taken by each of those

2-6  persons and a statement indicating whether the Board issued a

2-7  license to each of those persons;

2-8  (b) A description of the facts and circumstances under which

2-9  the Board exercised its discretion regarding whether to allow an

2-10  applicant for a license to take the examination for that license or

2-11  to issue a license to the applicant; and

2-12      (c) The number and types of complaints, if any, the Board

2-13  received regarding the procedure for applying for a license and

2-14  the procedure for issuance of a license.

2-15      Sec. 2.  NRS 625.100 is hereby amended to read as follows:

2-16      625.100  1.  The Governor shall appoint seven persons, [six]

2-17  four of whom must be engaged in the practice or teaching of

2-18  professional engineering in any of its disciplines except military

2-19  engineering, [and one] two of whom must be engaged in the practice

2-20  or teaching of land surveying [.] and one of whom must be a

2-21  member of the general public. The members must be citizens of the

2-22  United States and residents of this state, and constitute the State

2-23  Board of Professional Engineers and Land Surveyors.

2-24      2.  All appointments made for members who are engaged in

2-25  the practice or teaching of professional engineering or land

2-26  surveying must be made from the current roster of professional

2-27  engineers and professional land surveyors as issued by the Board

2-28  and on file in the office of the Secretary of State. Insofar as

2-29  practicable, membership on the Board of those members must be

2-30  distributed proportionately among the recognized disciplines of the

2-31  profession. [One of the members who is a professional land

2-32  surveyor must not be licensed as a professional engineer.] The

2-33  members who are professional land surveyors must not be

2-34  professional engineers.

2-35      3.  Within 30 days after his appointment, [a] each member shall

2-36  take and subscribe to the oath of office as prescribed by the laws of

2-37  Nevada and shall file the oath with the Secretary of State.

2-38      Sec. 3.  NRS 625.154 is hereby amended to read as follows:

2-39      625.154  1.  The Board shall hold examinations of applicants

2-40  for licenses at least once each year in localities determined by the

2-41  number of applications received.

2-42      2.  The examinations must be written and administered in

2-43  English.

2-44      3.  The Board shall not prohibit an applicant for a license

2-45  from taking a regularly scheduled examination for that license


3-1  solely because the Board failed to review the applicant’s

3-2  application before the examination. If the Board prohibits an

3-3  applicant for a license from taking the examination in violation of

3-4  this subsection, the Board shall hold or cause to be held an

3-5  examination for the applicant within 30 days after the violation

3-6  occurs.

3-7  Sec. 4.  NRS 625.383 is hereby amended to read as follows:

3-8  625.383  1.  Each professional engineer and professional land

3-9  surveyor shall obtain a stamp of the design authorized by the Board,

3-10  bearing his name and the number of his license and the legend

3-11  “Professional Engineer” followed by the discipline for which he is

3-12  qualified or the legend “Professional Land Surveyor,” respectively.

3-13      2.  To facilitate the obtaining of a stamp by a professional

3-14  engineer or professional land surveyor pursuant to subsection 1,

3-15  the Board shall, upon request, provide its authorized design to any

3-16  retailer or manufacturer of stamps. A professional engineer or

3-17  professional land surveyor may obtain his stamp from any retailer

3-18  or manufacturer of stamps.

3-19      3.  A professional land surveyor shall not use the legend

3-20  “Professional Engineer.”

3-21      Sec. 5.  1.  The term of each member of the State Board of

3-22  Professional Engineers and Land Surveyors expires on the effective

3-23  date of this act.

3-24      2.  As soon as practicable after the effective date of this act, the

3-25  Governor shall appoint to the Board:

3-26      (a) Three members who are engaged in the practice or teaching

3-27  of professional engineering, except military engineering, to serve for

3-28  terms of 3 years;

3-29      (b) One member who is engaged in the practice or teaching of

3-30  professional engineering, except military engineering, to serve for a

3-31  term of 2 years;

3-32      (c) One member who is engaged in the practice or teaching of

3-33  land surveying to serve for a term of 2 years;

3-34      (d) One member who is engaged in the practice or teaching of

3-35  land surveying to serve for a term of 1 year; and

3-36      (e) One member who is a member of the general public to serve

3-37  for a term of 1 year.

3-38      Sec. 6.  1.  This act becomes effective upon passage and

3-39  approval.

3-40      2.  Section 1 of this act expires by limitation on December 1,

3-41  2014.
