AN ACT relating to professions; requiring the State Board of Professional Engineers and Land Surveyors to submit annual reports regarding certain activities of the Board to the Director of the Legislative Counsel Bureau; revising the membership of the Board; requiring the Board to hold an examination for an applicant for a license under certain circumstances; requiring the Board to provide its authorized design for a stamp to a retailer or manufacturer under certain circumstances; exempting certain laser scanner operators from the licensure requirements applicable to professional engineers and land surveyors; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 625 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  On or before February 1 of each year, the Board shall

1-4  submit a report to the Director of the Legislative Counsel Bureau

1-5  for distribution to each member of the Senate Standing Committee


2-1  on Commerce and Labor and the Assembly Standing Committee

2-2  on Commerce and Labor.

2-3  2.  Each report submitted pursuant to subsection 1 must

2-4  include the following information for the previous calendar year:

2-5  (a) The number of persons who relied upon the provisions of

2-6  this chapter relating to education to qualify for the issuance of a

2-7  license, the results of each examination taken by each of those

2-8  persons and a statement indicating whether the Board issued a

2-9  license to each of those persons;

2-10      (b) A description of the facts and circumstances under which

2-11  the Board exercised its discretion regarding whether to allow an

2-12  applicant for a license to take the examination for that license or

2-13  to issue a license to the applicant; and

2-14      (c) The number and types of complaints, if any, the Board

2-15  received regarding the procedure for applying for a license and

2-16  the procedure for issuance of a license.

2-17      Sec. 2.  NRS 625.100 is hereby amended to read as follows:

2-18      625.100  1.  The Governor shall appoint seven persons, [six]

2-19  four of whom must be engaged in the practice or teaching of

2-20  professional engineering in any of its disciplines except military

2-21  engineering, [and one] two of whom must be engaged in the practice

2-22  or teaching of land surveying [.] and one of whom must be a

2-23  member of the general public. The members must be citizens of the

2-24  United States and residents of this state, and constitute the State

2-25  Board of Professional Engineers and Land Surveyors.

2-26      2.  All appointments made for members who are engaged in

2-27  the practice or teaching of professional engineering or land

2-28  surveying must be made from the current roster of professional

2-29  engineers and professional land surveyors as issued by the Board

2-30  and on file in the office of the Secretary of State. Insofar as

2-31  practicable, membership on the Board of those members must be

2-32  distributed proportionately among the recognized disciplines of the

2-33  profession. [One of the members who is a professional land

2-34  surveyor must not be licensed as a professional engineer.] The

2-35  members who are professional land surveyors must not be

2-36  professional engineers.

2-37      3.  Within 30 days after his appointment, [a] each member shall

2-38  take and subscribe to the oath of office as prescribed by the laws of

2-39  Nevada and shall file the oath with the Secretary of State.

2-40      Sec. 3.  NRS 625.154 is hereby amended to read as follows:

2-41      625.154  1.  The Board shall hold examinations of applicants

2-42  for licenses at least once each year in localities determined by the

2-43  number of applications received.

2-44      2.  The examinations must be written and administered in

2-45  English.


3-1  3.  The Board shall not prohibit an applicant for a license

3-2  from taking a regularly scheduled examination for that license

3-3  solely because the Board failed to review the applicant’s

3-4  application before the examination. If the Board prohibits an

3-5  applicant for a license from taking the examination in violation of

3-6  this subsection, the Board shall hold or cause to be held an

3-7  examination for the applicant within 30 days after the violation

3-8  occurs.

3-9  Sec. 4.  NRS 625.383 is hereby amended to read as follows:

3-10      625.383  1.  Each professional engineer and professional land

3-11  surveyor shall obtain a stamp of the design authorized by the Board,

3-12  bearing his name and the number of his license and the legend

3-13  “Professional Engineer” followed by the discipline for which he is

3-14  qualified or the legend “Professional Land Surveyor,” respectively.

3-15      2.  To facilitate the obtaining of a stamp by a professional

3-16  engineer or professional land surveyor pursuant to subsection 1,

3-17  the Board shall, upon request, provide its authorized design to any

3-18  retailer or manufacturer of stamps. A professional engineer or

3-19  professional land surveyor may obtain his stamp from any retailer

3-20  or manufacturer of stamps.

3-21      3.  A professional land surveyor shall not use the legend

3-22  “Professional Engineer.”

3-23      Sec. 5.  NRS 625.500 is hereby amended to read as follows:

3-24      625.500  1.  The licensure requirements of this chapter do not

3-25  apply to [the] :

3-26      (a) The employees of interstate or intrastate public utility

3-27  companies while they are engaged in work for those companies [or

3-28  to any] ;

3-29      (b) Any architect registered pursuant to the provisions of chapter

3-30  623 of NRS and who practices architecture as permitted by chapter

3-31  623 of NRS [.] ; or

3-32      (c) A person, while he is using a scanner for the purpose of

3-33  construction management or monitoring, or both, if he is certified

3-34  by the International Conference of Building Officials or a

3-35  successor organization for the purposes for which he is using the

3-36  scanner.

3-37      2.  As used in this section, “scanner” means a device that uses

3-38  laser technology to capture the digital shape of physical objects

3-39  through laser triangulation.

3-40      Sec. 6.  1.  The term of each member of the State Board of

3-41  Professional Engineers and Land Surveyors expires on the effective

3-42  date of this act.

3-43      2.  As soon as practicable after the effective date of this act, the

3-44  Governor shall appoint to the Board:


4-1  (a) Three members who are engaged in the practice or teaching

4-2  of professional engineering, except military engineering, to serve for

4-3  terms of 3 years;

4-4  (b) One member who is engaged in the practice or teaching of

4-5  professional engineering, except military engineering, to serve for a

4-6  term of 2 years;

4-7  (c) One member who is engaged in the practice or teaching of

4-8  land surveying to serve for a term of 2 years;

4-9  (d) One member who is engaged in the practice or teaching of

4-10  land surveying to serve for a term of 1 year; and

4-11      (e) One member who is a member of the general public to serve

4-12  for a term of 1 year.

4-13      Sec. 7.  1.  This act becomes effective upon passage and

4-14  approval.

4-15      2.  Section 1 of this act expires by limitation on December 1,

4-16  2014.
