AN ACT relating to higher education; requiring the Legislative Auditor to conduct an audit of the University and Community College System of Nevada and the Board of Regents of the University of Nevada; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 


2-1  Section 1. 1.  The Legislative Auditor shall conduct an audit

2-2  of the University and Community College System of Nevada and

2-3  the Board of Regents of the University of Nevada.

2-4  2.  The audit must include, without limitation, an analysis of:

2-5  (a) Capital construction projects;

2-6  (b) The cost of athletic programs, including, without limitation,

2-7  the sources and uses of money for such programs;

2-8  (c) The cost of administration, including, without limitation,

2-9  personnel, travel and other associated costs;

2-10      (d) The utilization of host accounts;

2-11      (e) The validity and reliability of enrollment data;

2-12      (f) The generation and distribution of investment income;

2-13      (g) Contracting and bidding procedures, including, without

2-14  limitation, construction, retrofit and repair projects and the use of

2-15  “shared savings” programs to pay for utility costs and energy

2-16  conservation projects; and

2-17      (h) Statewide programs, including, without limitation, program

2-18  selection, funding and outcomes.

2-19      3.  The Legislative Auditor shall present a final written report

2-20  of the audit to the Audit Subcommittee of the Legislative

2-21  Commission not later than February 7, 2005.

2-22      4.  The provisions of NRS 218.737 to 218.890, inclusive, apply

2-23  to the audit conducted pursuant to this section.

2-24      Sec. 2.  1.  Upon the request of the Legislative Auditor, the

2-25  University and Community College System of Nevada shall transfer

2-26  from its budget to the Audit Division of the Legislative Counsel

2-27  Bureau the sum of $90,000 to carry out the provisions of section 1

2-28  of this act.

2-29      2.  Any remaining balance of the sum transferred pursuant to

2-30  subsection 1 must not be committed for expenditure after

2-31  February 7, 2005, and reverts to the University and Community

2-32  College System of Nevada as soon as all payments of money

2-33  committed have been made.

2-34      Sec. 3.  This act becomes effective on July 1, 2003.
