AN ACT relating to motor vehicles; expanding the categories of vehicles for which the special license plates indicating support for the promotion of agriculture within this state may be issued; providing for the issuance of souvenir license plates indicating support for the promotion of agriculture within this state; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 482.37917 is hereby amended to read as
1-2 follows:
1-3 482.37917 1. Except as otherwise provided in this
1-4 subsection, the Department, in cooperation with the State
1-5 Department of Agriculture and the Nevada Future Farmers of
1-6 America Foundation[,] or its successor, shall design, prepare and
1-7 issue license plates which indicate support for the promotion of
1-8 agriculture within this state, including, without limitation, support
1-9 for the programs and activities of the Future Farmers of America or
1-10 its successor within this state, using any colors that the Department
1-11 deems appropriate. The design of the license plates must include the
1-12 phrase “People Grow Things Here!” and an identifying symbol
1-13 furnished by the Nevada Future Farmers of America Foundation[.]
2-1 or its successor. The Department shall not design, prepare or issue
2-2 the license plates unless it receives at least 250 applications for the
2-3 issuance of those plates.
2-4 2. If the Department receives at least 250 applications for the
2-5 issuance of license plates which indicate support for the promotion
2-6 of agriculture within this state, the Department shall issue those
2-7 plates for [a] :
2-8 (a) A passenger car [or] ;
2-9 (b) A light commercial vehicle ; and
2-10 (c) Any other vehicle that is required to be registered with the
2-11 Department, excluding motorcycles and vehicles registered with
2-12 the Department pursuant to NRS 706.801 to 706.861,
2-13 inclusive,
2-14 upon application by a person who is entitled to license plates
2-15 pursuant to NRS 482.265 and who otherwise complies with the
2-16 requirements for registration and licensing pursuant to this chapter.
2-17 A person may request that personalized prestige license plates
2-18 issued pursuant to NRS 482.3667 be combined with license plates
2-19 which indicate support for the promotion of agriculture within this
2-20 state if that person pays the fees for the personalized prestige license
2-21 plates in addition to the fees for the license plates which indicate
2-22 support for the promotion of agriculture within this state pursuant to
2-23 subsections 3 and 4.
2-24 3. The fee for license plates which indicate support for the
2-25 promotion of agriculture within this state is $35, in addition to all
2-26 other applicable registration and license fees and governmental
2-27 services taxes. The license plates are renewable upon the payment
2-28 of $10.
2-29 4. In addition to all [fees for the license,] other applicable
2-30 registration and license fees and governmental services taxes[,] and
2-31 the fee prescribed in subsection 3, a person who requests a set of
2-32 license plates which indicate support for the promotion of
2-33 agriculture within this state must pay for the initial issuance of the
2-34 plates an additional fee of $25 and for each renewal of the plates an
2-35 additional fee of $20, to be distributed in accordance with
2-36 subsection 5.
2-37 5. The Department shall deposit the fees collected pursuant to
2-38 subsection 4 with the State Treasurer for credit to the State General
2-39 Fund. The State Treasurer shall, on a quarterly basis, distribute the
2-40 fees deposited pursuant to this section in the following manner:
2-41 (a) Remit one-half of the fees to the Nevada Future Farmers of
2-42 America Foundation or its successor for the support of programs
2-43 and activities of the Future Farmers of America or its successor
2-44 within this state.
3-1 (b) Deposit one-half of the fees for credit to the Account for
3-2 License Plates for the Promotion of Agriculture within this state
3-3 created pursuant to NRS 561.411.
3-4 6. If, during a registration year, the holder of license plates
3-5 issued pursuant to the provisions of this section disposes of the
3-6 vehicle to which the plates are affixed, [he may retain] the holder
3-7 shall:
3-8 (a) Retain the plates and[:
3-9 (a) Affix] affix them to another vehicle that meets the
3-10 requirements of this section if the [transfer and registration fees are
3-11 paid as set out in this chapter; or] holder pays the fee for the
3-12 transfer of the registration and any registration fee or
3-13 governmental services tax due pursuant to NRS 482.399; or
3-14 (b) Within 30 days after removing the plates from the vehicle,
3-15 return them to the Department.
3-16 7. The Director shall, at the request of the Nevada Future
3-17 Farmers of America Foundation or its successor:
3-18 (a) Order the design and preparation of souvenir license plates
3-19 which indicate support for the promotion of agriculture within this
3-20 state; and
3-21 (b) Issue such souvenir license plates only to the Nevada
3-22 Future Farmers of America Foundation or its successor for a fee
3-23 established pursuant to NRS 482.3825. The Nevada Future
3-24 Farmers of America Foundation or its successor may resell such
3-25 souvenir license plates at a price determined by the Foundation or
3-26 its successor.
3-27 Sec. 2. NRS 482.500 is hereby amended to read as follows:
3-28 482.500 1. Except as otherwise provided in subsection 2 or 3,
3-29 whenever upon application any duplicate or substitute certificate of
3-30 registration, decal or number plate is issued, the following fees must
3-31 be paid:
3-32 For a certificate of registration....... $5.00
3-33 For every substitute number plate or set of plates 5.00
3-34 For every duplicate number plate or set of plates 10.00
3-35 For every decal displaying a county name .50
3-36 For every other decal, license plate sticker or tab 5.00
3-37 2. The following fees must be paid for any replacement plate or
3-38 set of plates issued for the following special license plates:
3-39 (a) For any special plate issued pursuant to NRS 482.3667,
3-40 482.3672, 482.3675, 482.370 to 482.376, inclusive, or 482.379 to
3-41 482.3816, inclusive, a fee of $10.
3-42 (b) For any special plate issued pursuant to NRS 482.368,
3-43 482.3765, 482.377 or 482.378, a fee of $5.
4-1 (c) Except as otherwise provided in NRS 482.37937 and
4-2 482.37945, and section 1 of this act, for any souvenir license plate
4-3 issued pursuant to NRS 482.3825 or sample license plate issued
4-4 pursuant to NRS 482.2703, a fee equal to that established by the
4-5 Director for the issuance of those plates.
4-6 3. A fee must not be charged for a duplicate or substitute of a
4-7 decal issued pursuant to NRS 482.37635.
4-8 4. The fees which are paid for duplicate number plates and
4-9 decals displaying county names must be deposited with the State
4-10 Treasurer for credit to the Motor Vehicle Fund and allocated to the
4-11 Department to defray the costs of duplicating the plates and
4-12 manufacturing the decals.
4-13 5. As used in this section:
4-14 (a) “Duplicate number plate” means a license plate or a set of
4-15 license plates issued to a registered owner which repeat the code of
4-16 a plate or set of plates previously issued to the owner to maintain his
4-17 registration using the same code.
4-18 (b) “Substitute number plate” means a license plate or a set of
4-19 license plates issued in place of a previously issued and unexpired
4-20 plate or set of plates. The plate or set of plates does not repeat the
4-21 code of the previously issued plate or set.
4-22 Sec. 3. This act becomes effective on July 1, 2003.
