AN ACT relating to motor vehicles; requiring certain vehicle dealers to provide copies of certain documents translated into Spanish for viewing by a purchaser or prospective purchaser of a motor vehicle under certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1.  Chapter 482 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  Each vehicle dealer who advertises that the Spanish

1-4  language is spoken at his place of business or who conducts

1-5  business by communicating in Spanish with a purchaser or

1-6  prospective purchaser regarding the potential purchase of a motor

1-7  vehicle shall:


2-1  (a) Arrange for or otherwise cause the translation into

2-2  Spanish of copies of all sales forms that the vehicle dealer uses on

2-3  a regular basis;

2-4  (b) Upon the request of a purchaser or prospective purchaser

2-5  of a motor vehicle with whom the vehicle dealer or his agent is

2-6  communicating or has communicated in Spanish as a part of the

2-7  preliminary discussions and negotiations regarding the purchase

2-8  or potential purchase of the vehicle, allow the purchaser or

2-9  prospective purchaser to view the copies described in paragraph

2-10  (a); and

2-11      (c) At each place of business, post in a conspicuous location a

2-12  legible sign written in Spanish, in not less than 48-point type,

2-13  advising purchasers and prospective purchasers of motor vehicles

2-14  of their right to view the copies described in paragraph (a) under

2-15  the circumstances described in paragraph (b).

2-16      2.  The Director shall adopt regulations to carry out the

2-17  requirements of this section in a uniform and orderly manner.

2-18      3.  As used in this section, “sales form” means any document

2-19  that:

2-20      (a) A vehicle dealer uses to reduce to writing an agreement or

2-21  contract, or an aspect thereof, for the sale of a motor vehicle by

2-22  the vehicle dealer to a private person; and

2-23      (b) The purchaser of the motor vehicle is required to sign, or

2-24  otherwise agree to, before the vehicle dealer turns over control of

2-25  the motor vehicle to the purchaser.

2-26      Sec. 2.  NRS 482.36414 is hereby amended to read as follows:

2-27      482.36414  A person who assumes operation of a franchise

2-28  pursuant to NRS 482.36396 to 482.36414, inclusive, must be

2-29  licensed as a dealer pursuant to the provisions of NRS 482.318 to

2-30  482.363, inclusive[.] , and section 1 of this act.

2-31      Sec. 3.  The Director of the Department of Motor Vehicles

2-32  shall adopt the regulations required by section 1 of this act on or

2-33  before January 1, 2004.

2-34      Sec. 4.  This act becomes effective upon passage and approval

2-35  for the purpose of adopting regulations by the Director of the

2-36  Department of Motor Vehicles to carry out the provisions of section

2-37  1 of this act and on July 1, 2004, for all other purposes.
