AN ACT relating to motor vehicles; requiring the Department of Motor Vehicles to establish a procedure pursuant to which the owner of a motor vehicle that is at least 25 years old may obtain a special permit to display a vintage license plate on the front of that motor vehicle under certain circumstances; requiring the Department to impose a reasonable fee for the issuance of such a special permit; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 482 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  The Department shall establish a procedure pursuant to

1-4  which an owner of a motor vehicle that is at least 25 years old may

1-5  apply for a special permit authorizing the owner to display a

1-6  vintage license plate on the front of that motor vehicle. The

1-7  Director of the Department shall, by regulation, set forth the

1-8  circumstances under which a person who holds such a special

1-9  permit may display a vintage license plate on the front of the

1-10  motor vehicle.

1-11      2.  The procedure established pursuant to subsection 1 must

1-12  provide that an applicant is authorized to receive such a special

1-13  permit upon:


2-1  (a) Submission of a completed application;

2-2  (b) Payment of the fee described in subsection 4; and

2-3  (c) Signing a declaration in which the applicant affirms that

2-4  he will affix a vintage license plate to the front of the motor

2-5  vehicle only under the circumstances authorized by the

2-6  Department for the display of a vintage license plate.

2-7  3.  A special permit issued pursuant to this section is valid for

2-8  a period of 1 year and may be renewed upon payment of the fee

2-9  described in subsection 4.

2-10      4.  The Department shall impose a reasonable fee, not to

2-11  exceed $35, for the issuance and renewal of a special permit

2-12  pursuant to this section. The fee described in this subsection is in

2-13  addition to any registration fee and governmental services tax that

2-14  the owner of the motor vehicle is required to pay to register that

2-15  motor vehicle.

2-16      5.  The provisions of this section do not relieve a person of the

2-17  duty to display on the rear of a motor vehicle a license plate that:

2-18      (a) Is not a vintage license plate; and

2-19      (b) Contains the required sticker, tab or other suitable device

2-20  indicating the current registration of the motor vehicle.

2-21      6.  The Director of the Department may adopt such additional

2-22  regulations as he determines are necessary to carry out the

2-23  provisions of this section.

2-24      7.  As used in this section, “vintage license plate” means a

2-25  license plate of a design that:

2-26      (a) Is not currently prepared or issued by the Department; and

2-27      (b) Has been reproduced to appear as it appeared at the time of

2-28  issuance.

2-29      Sec. 2.  NRS 482.265 is hereby amended to read as follows:

2-30      482.265  1.  The Department shall furnish to every owner

2-31  whose vehicle is registered two license plates for a motor vehicle

2-32  other than a motorcycle or power cycle, and one license plate for all

2-33  other vehicles required to be registered hereunder. Upon renewal of

2-34  registration, the Department may issue one or more license plate

2-35  stickers, tabs or other suitable devices in lieu of new license plates.

2-36      2.  [The] Except with respect to vintage license plates, the use

2-37  of which is authorized pursuant to section 1 of this act, the

2-38  Director shall have the authority to require the return to the

2-39  Department of all number plates upon termination of the lawful use

2-40  thereof by the owner under this chapter.

2-41      3.  Except as otherwise specifically provided by statute, for the

2-42  issuance of each special license plate authorized pursuant to this

2-43  chapter:

2-44      (a) The fee to be received by the Department for the initial

2-45  issuance of the special license plate is $35, exclusive of any


3-1  additional fee which may be added to generate funds for a particular

3-2  cause or charitable organization;

3-3  (b) The fee to be received by the Department for the renewal of

3-4  the special license plate is $10, exclusive of any additional fee

3-5  which may be added to generate financial support for a particular

3-6  cause or charitable organization; and

3-7  (c) The Department shall not design, prepare or issue a special

3-8  license plate unless, within 4 years after the date on which the

3-9  measure authorizing the issuance becomes effective, it receives at

3-10  least 250 applications for the issuance of that plate.

3-11      Sec. 3.  NRS 482.275 is hereby amended to read as follows:

3-12      482.275  1.  [The] Except as otherwise provided in section 1

3-13  of this act, the license plates for a motor vehicle other than a

3-14  motorcycle, power cycle or motor vehicle being transported by a

3-15  licensed vehicle transporter must be attached thereto, one in the

3-16  front and the other in the rear. The license plate issued for all other

3-17  vehicles required to be registered must be attached to the rear of the

3-18  vehicle. The license plates must be so displayed during the current

3-19  calendar year or registration period.

3-20      2.  Every license plate must at all times be securely fastened to

3-21  the vehicle to which it is assigned so as to prevent the plate from

3-22  swinging and at a height not less than 12 inches from the ground,

3-23  measuring from the bottom of such plate, in a place and position to

3-24  be clearly visible, and must be maintained free from foreign

3-25  materials and in a condition to be clearly legible.

3-26      3.  Any license plate which is issued to a vehicle transporter or

3-27  a dealer, rebuilder or manufacturer may be attached to a vehicle

3-28  owned or controlled by that person by a secure means. No license

3-29  plate may be displayed loosely in the window or by any other

3-30  unsecured method in any motor vehicle.
