AN ACT relating to public officers; increasing the compensation of district attorneys and sheriffs; authorizing a county to request and receive a waiver from the increases in compensation in the event of insufficient financial resources; providing that a waiver may not be applied for in certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 245.043 is hereby amended to read as follows:

1-2  245.043  1.  As used in this section:

1-3  (a) “County” includes Carson City.

1-4  (b) “County commissioner” includes the Mayor and supervisors

1-5  of Carson City.

1-6  2.  Except as otherwise provided by any special law, the elected

1-7  officers of the counties of this state are entitled to receive annual

1-8  salaries in the base amounts specified in the following table. The

1-9  annual salaries are in full payment for all services required by law to

1-10  be performed by such officers. Except as otherwise provided by law,

1-11  all fees and commissions collected by such officers in the

1-12  performance of their duties must be paid into the county treasury

1-13  each month without deduction of any nature.

4-5  Sec. 3. Except as otherwise provided in section 4 of this act,

4-6  each county shall:

4-7  1.  Commence payment of the increased annual salaries of the

4-8  elected officers of the county set forth in the table of annual salaries

4-9  contained in NRS 245.043, as amended by section 1 of this act, on

4-10  July 1, 2003.

4-11      2.  Commence payment of the increased annual salaries of the

4-12  elected officers of the county set forth in the table of annual salaries

4-13  contained in NRS 245.043, as amended by section 2 of this act, on

4-14  July 1, 2004.

4-15      Sec. 4. 1.  Except as otherwise provided in subsection 3, a

4-16  board of county commissioners may apply to the Committee on

4-17  Local Government Finance for a waiver from:

4-18      (a) The requirement to increase the annual salaries of elected

4-19  officers of the county to the annual salaries set forth in the table

4-20  contained in NRS 245.043, as amended by section 1 of this act, if

4-21  the board determines that the financial resources of the county are

4-22  insufficient to pay those increased annual salaries in Fiscal Year

4-23  2003-2004.

4-24      (b) The requirement to increase the annual salaries of elected

4-25  officers of the county to the annual salaries set forth in the table

4-26  contained in NRS 245.043, as amended by section 2 of this act, if

4-27  the board determines that the financial resources of the county are

4-28  insufficient to pay those increased annual salaries in Fiscal Year

4-29  2004-2005.

4-30  The Committee on Local Government Finance shall grant such a

4-31  waiver if it finds that the financial resources of the county are

4-32  insufficient to pay those increased annual salaries in the applicable

4-33  fiscal year.

4-34      2.  A board of county commissioners that has been granted a

4-35  waiver for a fiscal year may apply to the Committee on Local

4-36  Government Finance for an additional waiver for the next

4-37  consecutive fiscal year if it finds that the financial resources of the

4-38  county continue to be insufficient to pay the increased annual

4-39  salaries of the elected officers of the county set forth in the table

4-40  contained in NRS 245.043, as amended by section 1 or 2 of this act.

4-41  There is no limitation on the number of waivers for consecutive

4-42  fiscal years that the board of county commissioners may be granted

4-43  if the board of county commissioners finds that the financial

4-44  resources of the county continue to be insufficient to pay the


5-1  increased annual salaries of the elected officers of the county set

5-2  forth in the table contained in NRS 245.043, as amended by section

5-3  1 or 2 of this act, in that fiscal year.

5-4  3.  Except as otherwise provided in this subsection, after

5-5  commencing payment of the increased annual salaries of the elected

5-6  officers of the county set forth in the table contained in NRS

5-7  245.043, as amended by section 1 or 2 of this act, a board of county

5-8  commissioners may not apply for a waiver in any subsequent fiscal

5-9  year. The fact that a board of county commissioners has, in Fiscal

5-10  Year 2003-2004, paid the annual salaries set forth in the table

5-11  contained in NRS 245.043 as amended by section 1 of this act, does

5-12  not preclude the board of county commissioners from applying for

5-13  and being granted a waiver from paying the annual salaries set forth

5-14  in the table contained in NRS 245.043 as amended by section 2 of

5-15  this act in Fiscal Year 2004-2005 or in any consecutive year if the

5-16  Committee on Local Government Finance determines that the

5-17  financial resources of the county are insufficient to pay the

5-18  increased annual salaries of the elected officers of the county.

5-19      4.  The increased annual salaries of the elected officers of the

5-20  county set forth in the table contained in NRS 245.043, as amended

5-21  by section 1 or 2 of this act, must not be paid retroactively for a

5-22  period to which a waiver is applicable.

5-23      Sec. 5. The provisions of NRS 354.599 do not apply to any

5-24  additional expenses of a local government that are related to the

5-25  provisions of this act.

5-26      Sec. 6. 1.  This section and sections 1, 3, 4 and 5 of this act

5-27  become effective on July 1, 2003.

5-28      2.  Section 1 of this act expires by limitation on June 30, 2004.

5-29      3.  Section 2 of this act becomes effective on July 1, 2004.
