AN ACT relating to public officers; increasing the compensation of certain elected county officers; providing that a board of county commissioners may vote to raise the annual salary for a county commissioner of that county; authorizing a county to request and receive a waiver from the increases in compensation in the event of insufficient financial resources; providing that a waiver may not be applied for in certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 245.043 is hereby amended to read as follows:
1-2 245.043 1. As used in this section:
1-3 (a) “County” includes Carson City.
1-4 (b) “County commissioner” includes the Mayor and supervisors
1-5 of Carson City.
1-6 2. Except as otherwise provided by any special law, the elected
1-7 officers of the counties of this state are entitled to receive annual
1-8 salaries in the base amounts specified in the following table. The
1-9 annual salaries are in full payment for all services required by law to
1-10 be performed by such officers. Except as otherwise provided by law,
2-1 all fees and commissions collected by such officers in the
2-2 performance of their duties must be paid into the county treasury
2-3 each month without deduction of any nature.

2-41 3. Notwithstanding the provisions of subsection 2, a board of
2-42 county commissioners, by a vote of the majority of the board, may
3-1 set the annual salary for the county commissioners of that county
3-2 at a rate higher than the salary provided pursuant to subsection 2.
3-3 A board of county commissioners is not limited in the number of
3-4 times that it may raise the salary of the county commissioners for
3-5 that county.
3-6 Sec. 2. Except as otherwise provided in section 3 of this act,
3-7 each county shall commence payment of the increased annual
3-8 salaries of the elected officers of the county set forth in the table of
3-9 annual salaries contained in subsection 2 of NRS 245.043, as
3-10 amended by section 1 of this act, on July 1, 2003.
3-11 Sec. 3. 1. Except as otherwise provided in subsection 3, a
3-12 board of county commissioners may apply to the Committee on
3-13 Local Government Finance for a waiver from the requirement to
3-14 increase the annual salaries of elected officers of the county to the
3-15 annual salaries set forth in the table contained in subsection 2 of
3-16 NRS 245.043, as amended by section 1 of this act, if the board
3-17 determines that the financial resources of the county are insufficient
3-18 to pay those increased annual salaries in Fiscal Year 2003-2004. The
3-19 Committee on Local Government Finance shall grant such a waiver
3-20 if it finds that the financial resources of the county are insufficient to
3-21 pay those increased annual salaries in Fiscal Year 2003-2004.
3-22 2. A board of county commissioners that has been granted a
3-23 waiver for a fiscal year may apply to the Committee on Local
3-24 Government Finance for an additional waiver for the next
3-25 consecutive fiscal year if it finds that the financial resources of the
3-26 county continue to be insufficient to pay the increased annual
3-27 salaries of the elected officers of the county set forth in the table
3-28 contained in subsection 2 of NRS 245.043, as amended by section 1
3-29 of this act. There is no limitation on the number of waivers for
3-30 consecutive fiscal years that the board of county commissioners may
3-31 be granted if the board of county commissioners finds that the
3-32 financial resources of the county continue to be insufficient to pay
3-33 the increased annual salaries of the elected officers of the county set
3-34 forth in the table contained in subsection 2 of NRS 245.043, as
3-35 amended by section 1 of this act, in that fiscal year.
3-36 3. After commencing payment of the increased annual salaries
3-37 of the elected officers of the county set forth in the table contained
3-38 in subsection 2 of NRS 245.043, as amended by section 1 of this act,
3-39 a board of county commissioners may not apply for a waiver in any
3-40 subsequent fiscal year.
3-41 4. The increased annual salaries of the elected officers of the
3-42 county set forth in the table contained in subsection 2 of NRS
3-43 245.043, as amended by section 1 of this act, must not be paid
3-44 retroactively for a period to which a waiver granted pursuant to
3-45 subsection 1 is applicable.
4-1 Sec. 4. The provisions of subsection 1 of NRS 354.599 do not
4-2 apply to any additional expenses of a local government that are
4-3 related to the provisions of this act.
4-4 Sec. 5. This act becomes effective upon July 1, 2003.
