AN ACT relating to public officers; increasing the compensation of certain elected county officers; authorizing a board of county commissioners to set the annual salary for a county commissioner of that county within certain limitations; authorizing a county to request and receive a waiver from the increases in compensation of certain elected county officers in the event of insufficient financial resources; providing that a waiver may not be applied for in certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 245.043 is hereby amended to read as follows:

1-2  245.043  1.  As used in this section:

1-3  (a) “County” includes Carson City.

1-4  (b) “County commissioner” includes the Mayor and supervisors

1-5  of Carson City.


2-1  2.  Except as otherwise provided by any special law, the elected

2-2  officers of the counties of this state are entitled to receive annual

2-3  salaries in the base amounts specified in the following table. The

2-4  annual salaries are in full payment for all services required by law to

2-5  be performed by such officers. Except as otherwise provided by law,

2-6  all fees and commissions collected by such officers in the

2-7  performance of their duties must be paid into the county treasury

2-8  each month without deduction of any nature.

3-4  3.  A board of county commissioners may, by a vote of at least

3-5  a majority of all the members of the board, set the annual salary

3-6  for the county commissioners of that county, but in no event may

3-7  the annual salary exceed an amount which equals 126.65 percent

3-8  of the amount of the annual salary for the county commissioners

3-9  of that county that was in effect by operation of statute on

3-10  January 1, 2003.

3-11      Sec. 2.  Except as otherwise provided in section 3 of this act,

3-12  each county shall commence payment of the increased annual

3-13  salaries of the elected officers of the county set forth in the table of

3-14  annual salaries contained in subsection 2 of NRS 245.043, as

3-15  amended by section 1 of this act, on July 1, 2003.

3-16      Sec. 3.  1.  Except as otherwise provided in subsection 3, a

3-17  board of county commissioners may apply to the Committee on

3-18  Local Government Finance for a waiver from the requirement to

3-19  increase the annual salaries of elected officers of the county to the

3-20  annual salaries set forth in the table contained in subsection 2 of

3-21  NRS 245.043, as amended by section 1 of this act, if the board

3-22  determines that the financial resources of the county are insufficient

3-23  to pay those increased annual salaries in Fiscal Year 2003-2004. The

3-24  Committee on Local Government Finance shall grant such a waiver

3-25  if it finds that the financial resources of the county are insufficient to

3-26  pay those increased annual salaries in Fiscal Year 2003-2004.

3-27      2.  A board of county commissioners that has been granted a

3-28  waiver for a fiscal year may apply to the Committee on Local

3-29  Government Finance for an additional waiver for the next

3-30  consecutive fiscal year if it finds that the financial resources of the

3-31  county continue to be insufficient to pay the increased annual

3-32  salaries of the elected officers of the county set forth in the table

3-33  contained in subsection 2 of NRS 245.043, as amended by section 1

3-34  of this act. There is no limitation on the number of waivers for

3-35  consecutive fiscal years that the board of county commissioners may

3-36  be granted if the board of county commissioners finds that the

3-37  financial resources of the county continue to be insufficient to pay

3-38  the increased annual salaries of the elected officers of the county set

3-39  forth in the table contained in subsection 2 of NRS 245.043, as

3-40  amended by section 1 of this act, in that fiscal year.

3-41      3.  After commencing payment of the increased annual salaries

3-42  of the elected officers of the county set forth in the table contained

3-43  in subsection 2 of NRS 245.043, as amended by section 1 of this act,


4-1  a board of county commissioners may not apply for a waiver in any

4-2  subsequent fiscal year.

4-3  4.  The increased annual salaries of the elected officers of the

4-4  county set forth in the table contained in subsection 2 of NRS

4-5  245.043, as amended by section 1 of this act, must not be paid

4-6  retroactively for a period to which a waiver granted pursuant to

4-7  subsection 1 is applicable.

4-8  Sec. 4.  The provisions of subsection 1 of NRS 354.599 do not

4-9  apply to any additional expenses of a local government that are

4-10  related to the provisions of this act.

4-11      Sec. 5.  This act becomes effective upon July 1, 2003.
