AN ACT relating to education; extending the prospective expiration of certain provisions that authorize the board of trustees of a county school district to issue its general obligations to raise money to replace existing buildings or grounds for schools, and to purchase necessary equipment used in educating pupils, necessary furniture for school buildings and certain necessary equipment used for the transportation of pupils; requiring the board of trustees of a school district that issues its general obligations for such a purpose to prepare an annual written report describing the purposes for which the proceeds of the bonds were used; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
2-1 Section 1. NRS 387.335 is hereby amended to read as follows:
2-2 387.335 1. The board of trustees of a county school district
2-3 may issue its general obligations to raise money for the following
2-4 purposes, and no others:
2-5 (a) Construction, design or purchase of new buildings for
2-6 schools, including, but not limited to, teacherages, dormitories,
2-7 dining halls, gymnasiums and stadiums.
2-8 (b) Enlarging, remodeling, repairing or replacing existing
2-9 buildings or grounds for schools, including, but not limited to,
2-10 teacherages, dormitories, dining halls, gymnasiums and stadiums.
2-11 (c) Acquiring sites for building schools, or additional real
2-12 property for necessary purposes related to schools, including, but
2-13 not limited to, playgrounds, athletic fields and sites for stadiums.
2-14 (d) Paying expenses relating to the acquisition of school
2-15 facilities which have been leased by a school district pursuant to
2-16 NRS 393.080.
2-17 (e) Purchasing necessary furniture and equipment for schools,
2-18 including, without limitation, equipment used in educating pupils,
2-19 furniture for school buildings and equipment used for the
2-20 transportation of pupils. If money from the issuance of general
2-21 obligations is used to purchase furniture and equipment to replace
2-22 existing furniture and equipment, and that existing furniture and
2-23 equipment subsequently is sold, the proceeds from the sale must be
2-24 applied toward the retirement of those obligations. If equipment
2-25 used for the transportation of pupils is purchased pursuant to this
2-26 paragraph, only the following equipment may be purchased:
2-27 (1) Motor vehicles that use biodiesel, compressed natural gas
2-28 or a similar fuel formulated to reduce emissions from the amount of
2-29 emissions produced from traditional fuels such as gasoline and
2-30 diesel fuel;
2-31 (2) Equipment to retrofit motor vehicles to use biodiesel,
2-32 compressed natural gas or a similar fuel formulated to reduce
2-33 emissions from the amount of emissions produced from traditional
2-34 fuels such as gasoline and diesel fuel; or
2-35 (3) Equipment for the transportation, storage or dispensing of
2-36 biodiesel, compressed natural gas or similar fuels formulated to
2-37 reduce emissions from the amount of emissions produced from
2-38 traditional fuels such as gasoline and diesel fuel.
2-39 2. Any one or more of the purposes enumerated in subsection 1
2-40 may, by order of the board of trustees entered in its minutes, be
2-41 united and voted upon as one single proposition.
2-42 3. Any question submitted pursuant to this section and any
2-43 question submitted pursuant to NRS 387.3285 may, by order of the
2-44 board of trustees entered in its minutes, be united and voted upon as
2-45 a single proposition.
3-1 4. If a school district issues general obligations to:
3-2 (a) Replace existing buildings or grounds for schools, as set
3-3 forth in paragraph (b) of subsection 1; or
3-4 (b) Purchase equipment used in educating pupils, furniture for
3-5 school buildings or equipment used for the transportation of
3-6 pupils, as set forth in paragraph (e) of subsection 1,
3-7 the school district shall prepare an annual written report that
3-8 describes the purposes for which the proceeds of the bonds were
3-9 used in the immediately preceding year. The school district shall,
3-10 on or before October 1 of each year, submit the report to the
3-11 Department and maintain a copy of the report for inspection by
3-12 the general public.
3-13 5. As used in this section, “biodiesel” has the meaning ascribed
3-14 to it in 42 U.S.C. § 13220.
3-15 Sec. 2. Section 60 of chapter 456, Statutes of Nevada 2001, at
3-16 page 2338, is hereby amended to read as follows:
3-17 Sec. 60. 1. This section[,] and sections 48 and 59.5 of
3-18 this act become effective upon passage and approval.
3-19 2. Sections 1 to 22, inclusive, 24 to 36, inclusive, 38, 40
3-20 to 43, inclusive, 46, 47 and 49 to 59, inclusive, of this act
3-21 become effective on July 1, 2001.
3-22 3. Sections 37, 39, 44 and 45 of this act become
3-23 effective at 12:01 a.m. on July 1, 2001.
3-24 4. Section 23 of this act becomes effective at 12:02 a.m.
3-25 on July 1, 2001.
3-26 5. Section 48 of this act expires by limitation on July 1,
3-27 [2003.] 2007.
3-28 Sec. 3. This act becomes effective upon passage and approval.
3-29 H
