AN ACT relating to the Charter of the City of North Las Vegas; increasing the term of Office of Municipal Judges; authorizing an increase in salary to be applied during the current term of a Municipal Judge; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Section 4.005 of the Charter of the City of North
1-2 Las Vegas, being chapter 215, Statutes of Nevada 1997, at page 747,
1-3 is hereby amended to read as follows:
1-4 Sec. 4.005 Municipal Court.
1-5 1. There is a Municipal Court of the City which consists
1-6 of at least one department. Each department must be presided
1-7 over by a Municipal Judge and has such power and
1-8 jurisdiction as is prescribed in, and is, in all respects which
1-9 are not inconsistent with this Charter, governed by the
1-10 provisions of chapters 5 and 266 of NRS which relate to
1-11 Municipal Courts.
1-12 2. The City Council may, from time to time, by
1-13 ordinance, establish additional departments of the Municipal
2-1 Court and shall appoint an additional Municipal Judge for
2-2 each additional department.
2-3 3. At the first municipal primary or municipal general
2-4 election that follows the appointment of an additional
2-5 Municipal Judge to a newly created department of the
2-6 Municipal Court, the successor to that Municipal Judge must
2-7 be elected for [a] an initial term of [2 or 4] not more than 6
2-8 years, as determined by the City Council, in order that, as
2-9 nearly as practicable, [one-half] one-third of the number of
2-10 Municipal Judges be elected every 2 years.
2-11 4. Except as otherwise provided by the ordinance
2-12 establishing an additional department, each Municipal Judge
2-13 must be voted upon by the registered voters of the City at
2-14 large[.] and holds office for a period of 6 years and until his
2-15 successor has been elected and qualified.
2-16 5. The respective departments of the Municipal Court
2-17 must be numbered 1 through the appropriate Arabic numeral,
2-18 as additional departments are approved by the City Council.
2-19 A Municipal Judge must be elected for each department by
2-20 number.
2-21 Sec. 2. Section 4.020 of the Charter of the City of North Las
2-22 Vegas, being chapter 573, Statutes of Nevada 1971, as last amended
2-23 by chapter 215, Statutes of Nevada 1997, at page 748, is hereby
2-24 amended to read as follows:
2-25 Sec. 4.020 Municipal Court: Residency requirement of
2-26 Municipal Judge; salary.
2-27 1. A Municipal Judge must have been a resident of the
2-28 City for a continuous period of at least 6 months immediately
2-29 preceding his election.
2-30 2. If so required by an ordinance duly enacted,
2-31 candidates for the office of Municipal Judge, at the time of
2-32 filing, shall produce evidence in satisfaction of any or all of
2-33 the qualifications for office.
2-34 3. The salary of a Municipal Judge must be fixed by the
2-35 City Council[.] , must be uniform for all departments of the
2-36 Municipal Court and may be increased during the term for
2-37 which a Municipal Judge is elected or appointed.
2-38 Sec. 3. Section 5.010 of the Charter of the City of North Las
2-39 Vegas, being chapter 573, Statutes of Nevada 1971, as amended by
2-40 chapter 405, Statutes of Nevada 1981, at page 754, is hereby
2-41 amended to read as follows:
2-42 Sec. 5.010 General municipal elections.
2-43 1. [On the Tuesday after the 1st Monday in June 1981,
2-44 and at each successive interval of 4 years, there shall be
2-45 elected by the qualified voters of the city, at a general election
3-1 to be held for that purpose, a Municipal Judge, who shall hold
3-2 office for a period of 4 years and until his successor has been
3-3 elected and qualified.
3-4 2.] On the Tuesday after the [1st] first Monday in June
3-5 1977, and at each successive interval of 4 years thereafter,
3-6 there shall be elected by the qualified voters of the City, at a
3-7 general election to be held for that purpose, a Mayor and two
3-8 Councilmen, who shall hold office for a period of 4 years and
3-9 until their successors have been elected and qualified.
3-10 [3.] 2. On the Tuesday after the [1st] first Monday in
3-11 June 1975, and at each successive interval of 4 years
3-12 thereafter, there shall be elected by the qualified voters of the
3-13 City, at a general election to be held for that purpose, two
3-14 Councilmen, who shall hold office for a period of 4 years and
3-15 until their successors have been elected and qualified.
3-16 Sec. 4. The provisions of section 1 of this act do not apply to
3-17 the current term of any Municipal Judge elected or appointed before
3-18 October 1, 2003.
