AN ACT making appropriations to restore the balance in the Contingency Fund and to assist school districts in paying for health insurance for their employees; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. There is hereby appropriated from the State
1-2 General Fund to the Contingency Fund created by NRS 353.266 the
1-3 sum of $8,092,456 to restore and increase the balance in the
1-4 Contingency Fund attributable to the State General Fund to
1-5 $12,000,000.
1-6 2. There is hereby appropriated from the State Highway Fund
1-7 to the Contingency Fund created by NRS 353.266 the sum of
1-8 $1,889,536 to restore the balance in the Contingency Fund
1-9 attributable to the State Highway Fund to $2,000,000. The money
1-10 appropriated in this subsection must be accounted for separately and
1-11 may only be used for expenditures that may be properly made from
1-12 the State Highway Fund.
2-1 Sec. 2. 1. There is hereby appropriated from the State General
2-2 Fund to the Interim Finance Committee the sum of $5,800,000 to
2-3 provide allocations to school districts that incur unexpected
2-4 expenses related to providing health insurance for their employees
2-5 during the 2003-2005 biennium. No additional appropriation will be
2-6 made for this purpose. The money appropriated pursuant to this
2-7 subsection must not be used to negotiate the salaries of educational
2-8 personnel.
2-9 2. The State Board of Examiners shall adopt policies,
2-10 procedures and criteria for the review of requests for allocations
2-11 pursuant to subsection 3. Upon the adoption of such policies,
2-12 procedures and criteria, the State Board of Examiners shall transmit
2-13 a copy of the policies, procedures and criteria to the Interim Finance
2-14 Committee for approval. Upon approval of the policies, procedures
2-15 and criteria, the Interim Finance Committee shall transmit a copy of
2-16 the policies, procedures and criteria to the Department of Education.
2-17 The policies, procedures and criteria adopted by the State Board of
2-18 Examiners may not be used until they are approved by the Interim
2-19 Finance Committee.
2-20 3. If a school district finds that it has unexpected expenses
2-21 related to providing health insurance to its employees during the
2-22 2003-2005 biennium, the school district may submit a request to the
2-23 Department of Education for an allocation from the appropriation in
2-24 subsection 1.
2-25 4. The Department of Education, the Budget Division of the
2-26 Department of Administration and the Fiscal Analysis Division of
2-27 the Legislative Counsel Bureau shall jointly review a request
2-28 submitted pursuant to subsection 3, using the policies, procedures
2-29 and criteria approved by the Interim Finance Committee pursuant to
2-30 subsection 2. Upon completion of the review, a recommendation for
2-31 or against an allocation to the requesting school district must be
2-32 submitted by the Department of Education to the State Board of
2-33 Examiners.
2-34 5. The State Board of Examiners shall consider each request and
2-35 recommend the amount of the allocation, if any, to the Interim
2-36 Finance Committee.
2-37 6. The Interim Finance Committee is not required to approve the
2-38 entire amount of an allocation recommended pursuant to
2-39 subsection 5 or to allocate the entire amount appropriated by
2-40 subsection 1.
2-41 7. Any remaining balance of the sum appropriated by
2-42 subsection 1 must not be allocated by the Interim Finance
2-43 Committee after June 30, 2005, and reverts to the State General
2-44 Fund as soon as all payments of money committed have been made.
3-1 Sec. 3. This act becomes effective on July 1, 2003.
