AN ACT relating to industrial insurance; prohibiting an insurer from issuing a check for the payment of benefits for permanent total disability that includes a restrictive endorsement; providing that an insurer may issue a check for the payment of certain benefits for industrial insurance that includes a restrictive endorsement; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 616C of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. An insurer shall not issue a check pursuant to the
1-4 provisions of chapters 616A to 616D, inclusive, or chapter 617 of
2-1 NRS for the payment of permanent total disability benefits that
2-2 includes a restrictive endorsement.
2-3 2. An insurer may issue a check pursuant to the provisions of
2-4 chapters 616A to 616D, inclusive, or chapter 617 of NRS for the
2-5 payment of temporary total disability, temporary partial disability,
2-6 permanent partial disability or rehabilitation maintenance benefits
2-7 that includes a restrictive endorsement.
2-8 3. If an insurer issues a check that includes a restrictive
2-9 endorsement pursuant to subsection 2, the restrictive endorsement
2-10 must:
2-11 (a) Clearly and accurately state the restrictive conditions; and
2-12 (b) Not provide for any condition or restriction not authorized
2-13 under the provisions of chapters 616A to 616D, inclusive, or
2-14 chapter 617 of NRS.
2-15 Sec. 2. This act becomes effective on July 1, 2003.
