AN ACT relating to energy; providing a multiplier for electricity generated by certain renewable energy systems for the purpose of calculating compliance with a portfolio standard for renewable energy; deeming electricity generated by certain processes to be electricity not generated by a renewable energy system; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 704 of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 and 3 of this act.
1-3 Sec. 2. For the purpose of complying with a portfolio
1-4 standard established pursuant to NRS 704.7821, a provider shall
1-5 be deemed to have generated or acquired 2.4 kilowatt-hours of
1-6 electricity from a renewable energy system for each 1.0 kilowatt-
1-7 hour of actual electricity generated or acquired from a solar
1-8 photovoltaic system, if:
1-9 1. The system is installed on the premises of a retail
1-10 customer; and
2-1 2. On an annual basis, at least 50 percent of the electricity
2-2 generated by the system is utilized by the retail customer on that
2-3 premises.
2-4 Sec. 3. 1. Except as otherwise provided in subsection 2, any
2-5 electricity generated by a provider using any system that involves
2-6 drawing or creating electricity from tires must be deemed to have
2-7 not come from a renewable energy system for the purpose of
2-8 complying with a portfolio standard established pursuant to
2-9 NRS 704.7821.
2-10 2. For the purpose of complying with a portfolio standard
2-11 established pursuant to NRS 704.7821, a provider shall be deemed
2-12 to have generated or acquired 0.7 kilowatt-hours of electricity
2-13 from a renewable energy system for each 1.0 kilowatt-hour of
2-14 actual electricity generated or acquired from a system that utilizes
2-15 a reverse polymerization process, if:
2-16 (a) The system is installed on the premises of a retail
2-17 customer; and
2-18 (b) On an annual basis, at least 50 percent of the electricity
2-19 generated by the system is utilized by the retail customer on that
2-20 premises.
2-21 3. As used in this section:
2-22 (a) “Reverse polymerization process” means a process that
2-23 generates electricity from a tire that:
2-24 (1) Uses microwave reduction; and
2-25 (2) Does not involve combustion of the tire.
2-26 (b) “Tire” includes any tire for any vehicle or device in, upon
2-27 or by which any person or property is or may be transported or
2-28 drawn upon land.
2-29 Sec. 4. NRS 704.7801 is hereby amended to read as follows:
2-30 704.7801 As used in NRS 704.7801 to 704.7828, inclusive,
2-31 and sections 2 and 3 of this act, unless the context otherwise
2-32 requires, the words and terms defined in NRS 704.7805 to
2-33 704.7818, inclusive, have the meanings ascribed to them in those
2-34 sections.
2-35 Sec. 5. This act becomes effective on January 1, 2004.
