AN ACT relating to public employees; requiring a paid leave of absence of certain duration for public officers and employees who donate bone marrow or certain organs; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 281 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. Except as otherwise provided in this section, any public
1-4 officer or employee of the State or any agency thereof, or of a
1-5 political subdivision or an agency of a political subdivision must
1-6 be relieved from his duties to donate:
1-7 (a) Part of his bone marrow; or
1-8 (b) All or part of one of his organs.
1-9 2. The leave described in subsection 1 must be granted to a
1-10 public officer or employee without loss of his regular
1-11 compensation for such a period as is requested by the public
1-12 officer or employee but in no case to exceed:
1-13 (a) With respect to a donation of bone marrow, 7 working days
1-14 in any 1 calendar year; and
1-15 (b) With respect to the donation of all or part of an organ, 30
1-16 working days in any 1 calendar year.
2-1 3. Except as otherwise provided in subsection 5, the
2-2 mandatory paid leave described in subsection 2 must not be
2-3 counted against any annual vacation time, compensatory time or
2-4 sick leave time that a public officer or employee has accrued.
2-5 4. To be eligible for the mandatory paid leave described in
2-6 subsection 2, a public officer or employee must provide to his
2-7 employer a written, signed statement from a physician or from the
2-8 administrator of a hospital, attesting to:
2-9 (a) The fact that the public officer or employee has donated
2-10 bone marrow or all or part of one of his organs, or is scheduled to
2-11 make such a donation; and
2-12 (b) The particulars of the officer’s or employee’s donation,
2-13 including, without limitation:
2-14 (1) The date on which and the time at which the donation
2-15 took place or is scheduled to take place;
2-16 (2) The name of the medical facility at which the donation
2-17 took place or is scheduled to take place; and
2-18 (3) The name of the physician who harvested or is
2-19 scheduled to harvest the officer’s or employee’s bone marrow or
2-20 whole or partial organ.
2-21 5. If a public officer or employee obtains paid leave pursuant
2-22 to this section but does not ultimately make the donation for which
2-23 the leave was granted, the employer of the public officer or
2-24 employee may require the public officer or employee to reimburse
2-25 the employer accordingly, either through the payment of money or
2-26 the exchange of another type of paid leave that the public officer
2-27 or employee has accrued.
2-28 6. No part of this section prohibits an employer, after a public
2-29 officer or employee has exhausted the mandatory paid leave
2-30 described in subsection 2, from allowing the public officer or
2-31 employee to:
2-32 (a) Take unpaid leave;
2-33 (b) Use annual vacation time, compensatory time or sick leave
2-34 time; or
2-35 (c) Both (a) and (b),
2-36 if the employer reasonably believes that the public officer or
2-37 employee requires an additional period of relief from his duties to
2-38 recuperate from the donation of bone marrow or all or part of one
2-39 of his organs.
2-40 7. No period in which a public officer or employee is absent
2-41 from work to donate bone marrow or all or part of one of his
2-42 organs, or to recuperate from such a donation, whether the period
2-43 of absence is paid or unpaid, may be used as the basis for:
2-44 (a) Reducing the officer’s or employee’s benefits or seniority;
2-45 or
3-1 (b) Terminating the officer’s or employee’s position.
3-2 8. As used in this section:
3-3 (a) “Bone marrow” means the soft material that fills human
3-4 bone cavities.
3-5 (b) “Organ” means a vascularized human organ, all or part of
3-6 which is capable of being transplanted from a living human donor
3-7 to a living human recipient, including, without limitation:
3-8 (1) An organ such as a kidney, all of one of which is
3-9 capable of being transplanted from a living human donor to a
3-10 living human recipient; and
3-11 (2) An organ such as a liver, lung or pancreas, only part of
3-12 which is capable of being transplanted from a living human donor
3-13 to a living human recipient.
3-14 (c) “Vascularized human organ” means a human organ that
3-15 requires the continuous circulation of blood to remain useful for
3-16 purposes of transplantation.
