AN ACT relating to cancer; requiring the State Health Officer or a person designated by the Administrator of the Health Division of the Department of Human Resources to analyze information reported by health facilities concerning cancer; requiring the State Health Officer or person designated by the Administrator of the Health Division to analyze trends in such information and assist in facilitating the prevention of cancer; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 457 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  1.  The State Health Officer or a qualified person designated

1-4  by the Administrator of the Health Division shall analyze the

1-5  material obtained pursuant to NRS 457.230, 457.240 and 457.250

1-6  and the reports published pursuant to NRS 457.260 to determine


2-1  whether any trends exist in the incidence of cancer in a particular

2-2  area or population.

2-3  2.  If the State Health Officer or the person designated

2-4  pursuant to subsection 1 determines that a trend exists in the

2-5  incidence of cancer in a particular area or population, the State

2-6  Health Officer or the person designated pursuant to subsection 1

2-7  shall work with appropriate governmental, educational and

2-8  research entities to investigate the trend, advance research into the

2-9  trend and the cancer identified in the trend, and facilitate the

2-10  prevention and control of the cancer.

2-11      Sec.  2.  NRS 457.260 is hereby amended to read as follows:

2-12      457.260  1.  The Health Division shall publish reports based

2-13  upon the material obtained pursuant to NRS 457.230, 457.240 and

2-14  457.250 and shall make other appropriate uses of the material to

2-15  identify trends in the incidence of cancer in a particular area or

2-16  population, advance research and education concerning cancer and

2-17  improve treatment of the disease.

2-18      2.  The Health Division shall provide any qualified researcher

2-19  with data from the reported information upon:

2-20      (a) The researcher’s compliance with appropriate conditions as

2-21  established under the Board’s regulations; and

2-22      (b) His payment of a fee to cover the cost of providing the data.

2-23      Sec.  3.  This act becomes effective on July 1, 2003.
