AN ACT relating to public schools; requiring the Clark County School District to continue its pilot program for the replacement of certain schools; authorizing the Clark County School District to use a certain amount of money from its Fund for Capital Projects to finance the replacement of schools designated for its pilot program; encouraging school districts throughout this state to use certain innovative designs and resources in reconstructing certain schools; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. The Board of Trustees of the Clark County
1-2 School District shall continue the pilot program to replace schools
1-3 initially established pursuant to section 3 of chapter 562, Statutes of
1-4 Nevada 1999, at page 2947.
1-5 2. Notwithstanding the provisions of NRS 387.328 to the
1-6 contrary, the Board of Trustees of the Clark County School District
1-7 may use an amount not to exceed $230,000,000 from the Fund for
2-1 Capital Projects created pursuant to NRS 387.328 to reconstruct at
2-2 least 10 existing older schools, including, without limitation, inner
2-3 city schools, within the School District. The Board of Trustees shall
2-4 select the schools designated for reconstruction in accordance with
2-5 the policy adopted pursuant to NRS 393.103 concerning the
2-6 reconstruction of older buildings for schools or related facilities and
2-7 any priorities for reconstruction set forth in that policy. The schools
2-8 selected must include elementary schools, at least one middle school
2-9 or junior high school and at least one high school. The Board of
2-10 Trustees, upon designating the schools to be reconstructed, shall
2-11 with all deliberate speed commence the reconstruction of the
2-12 designated schools with a planned completion date of August 1,
2-13 2008.
2-14 3. On or before January 10, 2005, the Board of Trustees of the
2-15 Clark County School District shall submit to the Director of the
2-16 Legislative Counsel Bureau for transmission to the 73rd Session of
2-17 the Nevada Legislature an interim report regarding the pilot program
2-18 to replace schools. The report must include, without limitation, the
2-19 progress of reconstruction of the designated schools.
2-20 Sec. 2. The Legislature hereby encourages:
2-21 1. The Clark County School District to continue to construct
2-22 and reconstruct schools by using natural lighting (commonly
2-23 referred to as “daylighting”), multiple stories for buildings when
2-24 appropriate, solar and other renewable energy sources, and other
2-25 innovative building designs and plans to provide an effective and
2-26 ideal learning environment for pupils.
2-27 2. The remaining school districts throughout this state to
2-28 establish plans to reconstruct older schools, including, without
2-29 limitation, inner city schools, by using daylighting, multiple stories
2-30 when appropriate, solar and other renewable energy sources, and
2-31 other innovative building designs and plans to provide an effective
2-32 and ideal learning environment for pupils.
2-33 Sec. 3. This act becomes effective on July 1, 2003.
