AN ACT relating to industrial insurance; requiring certain periodic increases in the amount of compensation to which a claimant or a dependent of a claimant is entitled to receive for a permanent total disability under industrial insurance; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

 

2-1  Section 1. Chapter 616C of NRS is hereby amended by adding

2-2  thereto a new section to read as follows:

2-3  1.  If a claimant or a dependent of a claimant is entitled to

2-4  receive compensation pursuant to chapters 616A to 616D,

2-5  inclusive, of NRS for a permanent total disability caused by an

2-6  industrial injury or a disablement from an occupational disease:

2-7  (a) Before July 1, 2006, the claimant or dependent is entitled

2-8  to an increase in that compensation in the amount of 2 percent on

2-9  July 1, 2006;

2-10      (b) Before July 1, 2009, the claimant or dependent is entitled,

2-11  in addition to any increase provided pursuant to paragraph (a), to

2-12  an increase in that compensation in the amount of 3 percent on

2-13  July 1, 2009;

2-14      (c) Before July 1, 2012, the claimant or dependent is entitled,

2-15  in addition to any increase provided pursuant to paragraph (a) or

2-16  (b), to an increase in that compensation in the amount of 3.5

2-17  percent on July 1, 2012;

2-18      (d) Before July 1, 2015, the claimant or dependent is entitled,

2-19  in addition to any increase provided pursuant to paragraph (a), (b)

2-20  or (c), to an increase in that compensation in the amount of 4

2-21  percent on July 1, 2015; or

2-22      (e) Before July 1, 2017, the claimant or dependent is entitled,

2-23  in addition to any increase provided pursuant to paragraph (a),

2-24  (b), (c) or (d), to an increase in that compensation in the amount

2-25  of 5 percent on July 1, 2017.

2-26      2.  Any increase in compensation provided pursuant to this

2-27  section is in addition to any increase in compensation to which a

2-28  claimant or a dependent of a claimant is otherwise entitled by law.

2-29      Sec. 2.  This act becomes effective on July 1, 2003.
