AN ACT relating to public employees; requiring public employers to ensure that their employees comply with laws governing the registration of motor vehicles and obtaining drivers’ licenses; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 281 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 1. Each public employer shall confirm in the manner
1-4 provided in this section that all of its employees are in compliance
1-5 with chapter 482 of NRS concerning the registration of motor
1-6 vehicles and chapter 483 of NRS concerning drivers’ licenses.
1-7 2. Within 30 days after a person begins employment with a
1-8 public employer, as a condition of continued employment, the
1-9 person must provide evidence to the public employer that he has:
1-10 (a) Registered all motor vehicles that he owns in the manner
1-11 required in chapter 482 of NRS; and
1-12 (b) Obtained a driver’s license pursuant to chapter 483 of
1-13 NRS,
2-1 or evidence that he is not required by law to register such motor
2-2 vehicles or obtain such a license. The employment of an employee
2-3 who does not provide the evidence required by this subsection
2-4 within the prescribed time must be terminated. A public employer
2-5 shall maintain the evidence provided pursuant to this subsection.
2-6 3. The Department of Motor Vehicles shall, upon request,
2-7 assist a public employer in confirming that its employees have
2-8 complied with the requirements of this section.
2-9 4. As used in this section, “public employer” means an
2-10 agency of this state or a county, city, township, district or quasi-
2-11 municipal corporation.
2-12 Sec. 2. Each person who is employed on July 1, 2003, by a
2-13 public employer, as that term is defined in section 1 of this act, shall
2-14 provide the evidence prescribed in subsection 2 of that section on or
2-15 before January 1, 2004, to his public employer. The employment of
2-16 an employee who does not provide the evidence must be terminated
2-17 on that date.
2-18 Sec. 3. This act becomes effective on July 1, 2003.
