AN ACT relating to motor vehicles; transferring the Program for the Education of Motorcycle Riders from the Department of Motor Vehicles to the Department of Public Safety; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 480.110 is hereby amended to read as follows:
1-2 480.110 Except as otherwise provided therein, the Department
1-3 shall execute, administer and enforce, and perform the functions and
1-4 duties provided in:
1-5 1. Chapters 176A and 213 of NRS relating to parole and
1-6 probation;
1-7 2. Chapter 414 of NRS relating to emergency management;
1-8 3. Chapter 453 of NRS relating to controlled substances and
1-9 chapter 454 of NRS relating to dangerous drugs;
1-10 4. Chapter 459 of NRS relating to the transportation of
1-11 hazardous materials; [and]
1-12 5. Chapter 477 of NRS relating to the State Fire Marshal[.] ;
1-13 and
2-1 6. NRS 486.370 to 486.377, inclusive, and sections 5, 6 and 7
2-2 of this act relating to the education and safety of motorcycle
2-3 riders.
2-4 Sec. 2. NRS 481.015 is hereby amended to read as follows:
2-5 481.015 Except as otherwise provided in chapters 480 and
2-6 486A of NRS[,] and NRS 486.370 to 486.377, inclusive, and
2-7 sections 5, 6 and 7 of this act, as used in this title, unless the context
2-8 otherwise requires:
2-9 1. “Department” means the Department of Motor Vehicles.
2-10 2. “Director” means the Director of the Department of Motor
2-11 Vehicles.
2-12 Sec. 3. NRS 481.023 is hereby amended to read as follows:
2-13 481.023 1. Except as otherwise provided [therein,] in this
2-14 section and in the provisions of law described in this section, the
2-15 Department shall execute, administer and enforce, and perform the
2-16 functions and duties provided in:
2-17 (a) Chapter 108 of NRS, and perform such duties and exercise
2-18 such powers relating to liens on vehicles as may be conferred upon
2-19 it pursuant to chapter 108 of NRS or the provisions of any other law.
2-20 (b) Chapters 360A, 365, 366, 371 and 373 of NRS, relating to
2-21 the imposition and collection of taxes on motor fuels.
2-22 (c) Chapters 481, 482 to 486, inclusive, and 487 of NRS,
2-23 relating to motor vehicles. The Department shall not execute,
2-24 administer or enforce, or perform the functions or duties provided
2-25 in NRS 486.370 to 486.377, inclusive, and sections 5, 6 and 7 of
2-26 this act relating to the education and safety of motorcycle riders.
2-27 (d) Chapter 706 of NRS relating to licensing of motor vehicle
2-28 carriers and the use of public highways by those carriers.
2-29 (e) The provisions of NRS 426.401 to 426.461, inclusive.
2-30 2. The Department shall perform such other duties and exercise
2-31 such other powers as may be conferred upon the Department.
2-32 Sec. 4. Chapter 486 of NRS is hereby amended by adding
2-33 thereto the provisions set forth as sections 5, 6 and 7 of this act.
2-34 Sec. 5. As used in NRS 486.370 to 486.377, inclusive, and
2-35 sections 5, 6 and 7 of this act, unless the context otherwise
2-36 requires, the words and terms defined in NRS 486.370 and
2-37 sections 6 and 7 of this act have the meanings ascribed to them in
2-38 those sections.
2-39 Sec. 6. “Department” means the Department of Public
2-40 Safety.
2-41 Sec. 7. “Director” means the Director of the Department of
2-42 Public Safety.
2-43 Sec. 8. NRS 486.370 is hereby amended to read as follows:
2-44 486.370 [As used in NRS 486.372 to 486.377, inclusive,
2-45 “motorcycle”] “Motorcycle” does not include a trimobile.
3-1 Sec. 9. This act becomes effective upon passage and approval.
