AN ACT relating to public health; abolishing the Commission on Substance Abuse Education, Prevention, Enforcement and Treatment within the Department of Public Safety; abolishing the Fund for Substance Abuse Education, Prevention, Enforcement and Treatment; providing for the transfer of money in the Fund to the Department of Human Resources’ Gift Fund; repealing the requirement of establishing pilot projects in family resource centers to provide services relating to substance abuse; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. NRS 458.370, 458.380, 458.390, 458.400,
1-2 458.420, 458.431 and 458.441 are hereby repealed.
1-3 2. Sections 37 and 38 of chapter 394, Statutes of Nevada 1999,
1-4 at pages 1891 and 1892, respectively, are hereby repealed.
1-5 Sec. 2. 1. The State Controller shall transfer any balance in
1-6 the Fund for Substance Abuse Education, Prevention, Enforcement
1-7 and Treatment, created by NRS 458.400, which has not been
1-8 committed for expenditure on or before June 30, 2003, to the
1-9 Department of Human Resources’ Gift Fund, created by
1-10 NRS 232.355.
2-1 2. Money transferred from the Fund for Substance Abuse
2-2 Education, Prevention, Enforcement and Treatment to the
2-3 Department of Human Resources’ Gift Fund pursuant to this
2-4 section:
2-5 (a) Must be accounted for separately within the Department of
2-6 Human Resources’ Gift Fund; and
2-7 (b) If any of the money was initially accepted as part of a gift or
2-8 grant that restricted the expenditure of the money for a specific
2-9 purpose, that money must, to the extent practicable, be expended in
2-10 a manner consistent with the restriction.
2-11 Sec. 3. This act becomes effective on July 1, 2003.

2-26 Section 37 of chapter 394, Statutes of Nevada 1999:
2-27 Sec. 37. 1. The department of human resources shall
2-28 establish three pilot projects in family resource centers as
2-29 follows:
2-30 (a) One pilot project must be located in a family resource
2-31 center that is located in a county whose population is 400,000
2-32 or more;
2-33 (b) One pilot project must be located in a family resource
2-34 center that is located in a county whose population is 100,000
2-35 or more but less than 400,000; and
3-1 (c) One pilot project must be located in a family resource
3-2 center that is located in a county whose population is less
3-3 than 100,000.
3-4 2. Each pilot project must provide families with services
3-5 related to the prevention of substance abuse and intervention
3-6 into problems of substance abuse.
3-7 3. The commission shall:
3-8 (a) Define the scope of the services that must be provided
3-9 by the pilot projects;
3-10 (b) Prepare requests for proposals based on the scope of
3-11 the services needed;
3-12 (c) Set appropriate deadlines for receiving such proposals;
3-13 (d) Accept such proposals; and
3-14 (e) Review on a competitive basis the proposals submitted
3-15 and award the pilot projects.
3-16 4. The local governing board of a family resource center
3-17 in which a pilot project has been established shall, for each
3-18 calendar year in which the family resource center provides
3-19 services pursuant to the pilot project, submit a report to the
3-20 commission and the director of the department of human
3-21 resources, and to the director of the legislative counsel bureau
3-22 for transmittal to the appropriate legislative committees. The
3-23 report must include:
3-24 (a) The kinds of services offered pursuant to the pilot
3-25 project during the previous 12 months;
3-26 (b) The number of adolescents and adults who received
3-27 services pursuant to the pilot project during the previous 12
3-28 months;
3-29 (c) An estimate of the number of adolescents and adults in
3-30 the community served by the family resource center who are
3-31 or may be in need of services relating to substance abuse, and
3-32 a description of the services needed; and
3-33 (d) Such other information as the commission or the
3-34 director of the department of human resources requests.
3-35 5. As used in this section:
3-36 (a) “Commission” means the commission on substance
3-37 abuse education, prevention, enforcement and treatment
3-38 created within the department of motor vehicles and public
3-39 safety pursuant to NRS 458.380.
3-40 (b) “Family resource center” means a family resource
3-41 center established and operated pursuant to chapter 430A of
3-42 NRS.
3-43 Section 38 of chapter 394, Statutes of Nevada 1999:
3-44 Sec. 38. The bureau of alcohol and drug abuse in the
3-45 department of human resources shall make available from its
4-1 existing federal and state funding sources the sum of
4-2 $158,400 for the three pilot projects to be established
4-3 pursuant to section 37 of this act.
