AN ACT relating to construction; providing for the adoption of certain seismic requirements by the State Public Works Board and certain governing bodies; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 341 of NRS is hereby amended by adding
1-2 thereto a new section to read as follows:
1-3 For the purposes of the design, construction or repair of
1-4 buildings or other projects of this state, the Board shall adopt:
1-5 1. The seismic provisions of the International Building Code
1-6 adopted by the International Code Council; and
1-7 2. The guidelines adopted by the Division of Emergency
1-8 Management of the Department of Public Safety pursuant to
1-9 section 3 of this act.
1-10 Sec. 2. NRS 278.580 is hereby amended to read as follows:
1-11 278.580 1. Subject to the limitation set forth in NRS 244.368,
1-12 the governing body of any city or county may adopt a building code,
1-13 specifying the design, soundness and materials of structures, and
2-1 may adopt rules, ordinances and regulations for the enforcement of
2-2 the building code.
2-3 2. The governing body may also fix a reasonable schedule of
2-4 fees for the issuance of building permits. A schedule of fees so fixed
2-5 does not apply to the State of Nevada, the University and
2-6 Community College System of Nevada or any school district, except
2-7 that such entities may contract with the governing body to pay such
2-8 fees for the issuance of building permits, the review of plans and the
2-9 inspection of construction. Except as it may agree to in such a
2-10 contract, a governing body is not required to provide for the review
2-11 of plans or the inspection of construction with respect to a structure
2-12 of the State of Nevada, the University and Community College
2-13 System of Nevada or any school district.
2-14 3. Notwithstanding any other provision of law, the State and its
2-15 political subdivisions shall comply with all zoning regulations
2-16 adopted pursuant to this chapter, except for the expansion of any
2-17 activity existing on April 23, 1971.
2-18 4. A [local] governing body shall amend its building codes to
2-19 permit the use of straw or other materials and technologies which
2-20 conserve scarce natural resources or resources that are renewable in
2-21 the construction of a structure and the use of solar energy for the
2-22 heating of a structure, to the extent the local climate allows, as
2-23 intended by:
2-24 (a) The Uniform Building Code adopted by the International
2-25 Conference of Building Officials in the form most recently
2-26 published before March 1, 1995; and
2-27 (b) The Model Energy Code adopted by the Council of
2-28 American Building Officials in the form most recently published
2-29 before March 1, 1995.
2-30 5. A governing body shall amend its building codes to
2-31 include:
2-32 (a) The seismic provisions of the International Building Code
2-33 adopted by the International Code Council; and
2-34 (b) The guidelines adopted by the Division of Emergency
2-35 Management of the Department of Public Safety pursuant to
2-36 section 3 of this act.
2-37 Sec. 3. Chapter 414 of NRS is hereby amended by adding
2-38 thereto a new section to read as follows:
2-39 For the purpose of the inspection of structures and the
2-40 enforcement of building codes pursuant to NRS 278.570, 278.573,
2-41 278.575 and 341.145, the Chief shall adopt by regulation
2-42 guidelines for the investigation of hazards relating to seismic
2-43 activity, including, without limitation:
3-1 1. Potential surface ruptures; and
3-2 2. Liquefaction.
