AN ACT relating to construction; requiring the State Public Works Board to adopt certain seismic standards; requiring certain governing bodies to amend their building codes to include certain seismic standards; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 341 of NRS is hereby amended by adding

1-2  thereto a new section to read as follows:

1-3  For the purposes of the design and construction of buildings or

1-4  other projects of this state, the Board shall adopt by regulation:

1-5  1.  The seismic provisions of the International Building Code

1-6  published by the International Code Council; and

1-7  2.  Standards for the investigation of hazards relating to

1-8  seismic activity, including, without limitation, potential surface

1-9  ruptures and liquefaction.

 

 

 


2-1  Sec. 2.  NRS 278.580 is hereby amended to read as follows:

2-2  278.580  1.  Subject to the limitation set forth in NRS 244.368,

2-3  the governing body of any city or county may adopt a building code,

2-4  specifying the design, soundness and materials of structures, and

2-5  may adopt rules, ordinances and regulations for the enforcement of

2-6  the building code.

2-7  2.  The governing body may also fix a reasonable schedule of

2-8  fees for the issuance of building permits. A schedule of fees so fixed

2-9  does not apply to the State of Nevada, the University and

2-10  Community College System of Nevada or any school district, except

2-11  that such entities may contract with the governing body to pay such

2-12  fees for the issuance of building permits, the review of plans and the

2-13  inspection of construction. Except as it may agree to in such a

2-14  contract, a governing body is not required to provide for the review

2-15  of plans or the inspection of construction with respect to a structure

2-16  of the State of Nevada, the University and Community College

2-17  System of Nevada or any school district.

2-18      3.  Notwithstanding any other provision of law, the State and its

2-19  political subdivisions shall comply with all zoning regulations

2-20  adopted pursuant to this chapter, except for the expansion of any

2-21  activity existing on April 23, 1971.

2-22      4.  A [local] governing body shall amend its building codes to

2-23  permit the use of straw or other materials and technologies which

2-24  conserve scarce natural resources or resources that are renewable in

2-25  the construction of a structure and the use of solar energy for the

2-26  heating of a structure, to the extent the local climate allows . [, as

2-27  intended by:

2-28      (a) The Uniform Building Code adopted by the International

2-29  Conference of Building Officials in the form most recently

2-30  published before March 1, 1995; and

2-31      (b) The Model Energy Code adopted by the Council of

2-32  American Building Officials in the form most recently published

2-33  before March 1, 1995.]

2-34      5.  A governing body shall amend its building codes to

2-35  include:

2-36      (a) The seismic provisions of the International Building Code

2-37  published by the International Code Council; and

2-38      (b) Standards for the investigation of hazards relating to

2-39  seismic activity, including, without limitation, potential surface

2-40  ruptures and liquefaction.

2-41      Sec. 3.  This act becomes effective:

2-42      1.  On July 1, 2003, for the purposes of the State Public Works

2-43  Board adopting the seismic provisions and standards specified in

2-44  section 1 of this act; and


3-1  2.  On July 1, 2004, for all other purposes, including for the

3-2  purpose of a governing body to amend its building codes to include

3-3  the seismic provisions and standards specified in subsection 5 of

3-4  NRS 278.580, as amended by section 2 of this act.
