AN ACT relating to brownfield sites; creating a revolving fund to finance the remediation of brownfield sites; requiring the Division of Environmental Protection of the State Department of Conservation and Natural Resources to administer the fund; providing for the uses of money in the fund; authorizing the Administrator of the Division to impose a fee; authorizing the State Environmental Commission to adopt regulations; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. Chapter 459 of NRS is hereby amended by adding

1-2  thereto the provisions set forth as sections 2 to 18, inclusive, of this

1-3  act.

1-4  Sec. 2.  As used in sections 2 to 18, inclusive, of this act,

1-5  unless the context otherwise requires, the words and terms defined

1-6  in sections 3 to 10, inclusive, of this act have the meanings

1-7  ascribed to them in those sections.


2-1  Sec. 3.  “Administrator” means the Administrator of the

2-2  Division.

2-3  Sec. 4.  “Brownfield project” means a project for the

2-4  remediation of a brownfield site for future or alternative use.

2-5  Sec. 5.  “Brownfield site” has the meaning ascribed to it in 42

2-6  U.S.C. § 9601.

2-7  Sec. 6.  “Brownfields Restoration Act” means the Small

2-8  Business Liability Relief and Brownfields Revitalization Act,

2-9  Public Law 107-118.

2-10      Sec. 7.  “Commission” means the State Environmental

2-11  Commission.

2-12      Sec. 8.  “Division” means the Division of Environmental

2-13  Protection of the State Department of Conservation and Natural

2-14  Resources.

2-15      Sec. 9.  “Federal grant” means money authorized by 42

2-16  U.S.C § 9604(k) to create a revolving fund to finance the costs of

2-17  brownfield projects.

2-18      Sec. 10.  “Fund” means the Fund for Brownfield Projects

2-19  created pursuant to section 11 of this act.

2-20      Sec. 11.  1.  The Fund for Brownfield Projects is hereby

2-21  created in the State Treasury as a revolving fund, to be

2-22  administered by the Division.

2-23      2.  Money in the Fund may be used only to carry out

2-24  brownfield projects authorized pursuant to the Brownfields

2-25  Restoration Act. Interest and income earned on the money in the

2-26  Fund must be credited to the Fund. Money remaining in the Fund

2-27  at the end of a fiscal year does not revert to the State General

2-28  Fund, and the balance in the Fund for Brownfield Projects must

2-29  be carried forward.

2-30      3.  All payments reimbursing the cost of cleanups for

2-31  brownfield projects, including interest, must be deposited in the

2-32  State Treasury for credit to the Fund.

2-33      4.  Claims against the Fund must be paid as other claims

2-34  against the State are paid.

2-35      5.  The Division may accept gifts, appropriations,

2-36  contributions, grants and bequests of money from any public or

2-37  private sources. Money so accepted must be deposited in the State

2-38  Treasury for credit to the Fund and may be used to match the

2-39  federal grant.

2-40      Sec. 12.  Except as otherwise provided in section 13 of this

2-41  act, money in the Fund, including reimbursements, repayment of

2-42  principal and interest on loans and other financial assistance, and

2-43  interest earned on money in the Fund, may be used only to

2-44  finance the cleanup of brownfield sites or provide other assistance

2-45  to brownfield projects.


3-1  Sec. 13.  With regard to the money from the federal grant in

3-2  the Fund, the Administrator shall not spend more than the

3-3  federally approved amounts for the administration and fiscal or

3-4  financial oversight of the Fund.

3-5  Sec. 14.  The Division shall:

3-6  1.  Use the money in the Fund for the purposes set forth in the

3-7  Brownfields Restoration Act.

3-8  2.  Determine whether brownfield projects which receive

3-9  money or other assistance from the Fund comply with the

3-10  Brownfields Restoration Act.

3-11      Sec. 15.  The Division may:

3-12      1.  Prepare and enter into any agreements with the Federal

3-13  Government for the acceptance of grants of money for the Fund.

3-14      2.  Bind itself to terms of such an agreement.

3-15      3.  Accept grants made pursuant to the Brownfields

3-16  Restoration Act.

3-17      4.  Manage the Fund in accordance with requirements and

3-18  objectives of the Brownfields Restoration Act.

3-19      5.  Provide services relating to the management and

3-20  administration of the Fund, including the preparation of any

3-21  agreement, plan or report.

3-22      Sec. 16.  The Administrator may impose and collect a fee, in

3-23  an amount established by the Commission by regulation, from

3-24  each recipient that receives financial assistance from the Fund.

3-25  The fee must be used to defray the costs of administering the

3-26  Fund.

3-27      Sec. 17.  The Administrator may employ any legal, fiscal,

3-28  engineering and other expert services necessary to carry out his

3-29  duties pursuant to sections 2 to 18, inclusive, of this act.

3-30      Sec. 18.  The Commission may adopt such regulations as are

3-31  necessary to carry out the provisions of sections 2 to 18, inclusive,

3-32  of this act.

3-33      Sec. 19.  This act becomes effective upon passage and

3-34  approval.

 

3-35  H
