Assembly Concurrent RESOLUTION—Directing the Legislative Commission to conduct an interim study of telecommunication services in this state.

 

1-1  Whereas, The development and availability of

1-2  telecommunication services continue to improve and enrich the

1-3  quality of life for the residents of this state; and

1-4  Whereas, Providing telecommunication services efficiently

1-5  and economically is essential for maintaining a strong and vibrant

1-6  economy in this state; and

1-7  Whereas, The regulation and taxation of telecommunication

1-8  companies affect economic growth in this state; now, therefore, be it

1-9  Resolved by the Assembly of the State of Nevada, the

1-10  Senate Concurring, That the Legislative Commission is hereby

1-11  directed to appoint an interim committee, composed of three

1-12  members of the Assembly and three members of the Senate, one of

1-13  whom must be appointed as Chairman of the committee, to conduct

1-14  a study of telecommunication services in this state; and be it further

1-15      Resolved, That an advisory committee is hereby established

1-16  consisting of:

1-17      1.  One member appointed by the Chairman of the Legislative

1-18  Commission;

1-19      2.  One member appointed by the Bureau of Consumer

1-20  Protection in the Office of the Attorney General;


2-1  3.  One member, appointed by the Director of the Department

2-2  of Administration, who is employed by the Department of

2-3  Administration;

2-4  4.  Two members appointed by the Governor who represent

2-5  incumbent local exchange carriers, as defined in NRS 704.68932,

2-6  which serve 100,000 or more persons in this state;

2-7  5.  One member appointed by the Governor who represents an

2-8  interexchange carrier, as defined in NRS 704.040, which is doing

2-9  business in this state;

2-10      6.  One member appointed by the Governor who represents a

2-11  competitive supplier, as defined in NRS 704.6892, which is doing

2-12  business in this state; and

2-13      7.  One member appointed by the Governor who is a

2-14  representative of the general public; and be it further

2-15      Resolved, That the advisory committee consult with the

2-16  interim committee and provide assistance in conducting the study;

2-17  and be it further

2-18      Resolved, That each member of the advisory committee who is

2-19  not an officer or employee of the State serves without compensation

2-20  and is not entitled to receive a per diem allowance or travel

2-21  expenses; and be it further

2-22      Resolved, That each member of the advisory committee who is

2-23  an officer or employee of the State must be relieved from his duties

2-24  without loss of his regular compensation so that he may attend

2-25  meetings of the committee and is entitled to receive the per diem

2-26  allowance and travel expenses provided for state officers and

2-27  employees generally, which must be paid by the state agency that

2-28  employs him; and be it further

2-29      Resolved, That the study must include, without limitation, an

2-30  evaluation of:

2-31      1.  The methods presently used to determine the rates for

2-32  telecommunication services provided in this state;

2-33      2.  The feasibility of eliminating any implicit subsidies based

2-34  upon the type and location of the telecommunication service

2-35  provided in this state; and

2-36      3.  The feasibility of determining rates for telecommunication

2-37  services provided in this state without the use of implicit subsidies

2-38  based upon the type and location of telecommunication services

2-39  provided in this state; and be it further

2-40      Resolved, That any recommended legislation proposed by the

2-41  interim committee must be approved by a majority of the members

2-42  of the Senate and a majority of the members of the Assembly

2-43  appointed to the committee; and be it further


3-1  Resolved, That the Legislative Commission shall submit a

3-2  report of the results of the study and any recommendations for

3-3  legislation to the 73rd Session of the Nevada Legislature.
