Assembly Joint RESOLUTION—Proposing to amend the Nevada Constitution to allow the Legislature to authorize the State to operate a lottery.

 

1-1  Resolved by the Assembly and Senate of the State of

1-2  Nevada, Jointly, That Section 24 of Article 4 of the Nevada

1-3  Constitution be amended to read:

1-4  [Sec:] Sec. 24. 1.  [Except as otherwise provided in

1-5  subsection 2, no lottery may be authorized by this State, nor

1-6  may lottery tickets be sold.] The legislature may authorize a

1-7  lottery to be operated by the State of Nevada. If the

1-8  legislature authorizes such a lottery, the legislature shall, by

1-9  law:

1-10      (a) Determine the appropriate manner of operation for

1-11  the lottery; and

1-12      (b) Provide by appropriation for the disbursements of

1-13  the proceeds of the lottery, less expenses directly related to

1-14  the operation of the lottery.


2-1  2.  The [State and the] political subdivisions [thereof] of

2-2  this state shall not operate a lottery.

2-3  3.  The legislature may authorize persons engaged in

2-4  charitable activities or activities not for profit to operate a

2-5  lottery in the form of a raffle or drawing on their own behalf.

2-6  All proceeds of the lottery, less expenses directly related to

2-7  the operation of the lottery, must be used only to benefit

2-8  charitable or nonprofit activities in this state. A charitable or

2-9  nonprofit organization shall not employ or otherwise engage

2-10  any person to organize or operate its lottery for compensation.

2-11  The legislature may provide by law for the regulation of such

2-12  lotteries.
