1-1  Assembly Joint RESOLUTION—Proposing to amend the Nevada Constitution to require gubernatorial appointment of members to the Board of Regents based on certain recommendations and qualifications and to specify the number and terms of members.

 

1-2  Resolved by the Assembly and Senate of the State of

1-3  Nevada, Jointly, That Section 7 of Article 11 of the Nevada

1-4  Constitution be amended to read as follows:

1-5  [Sec: 7.  The Governor, Secretary of State, and

1-6  Superintendent of Public Instruction, shall for the first Four

1-7  Years and until their successors are elected and qualified

1-8  constitute]

1-9  Sec. 7.  1.  There is hereby created a Board of Regents

1-10  to control and manage the affairs of the University and the

1-11  funds of the same under such regulations as may be provided

1-12  by law. [But the]

1-13      2.  The Board of Regents consists of seven members

1-14  appointed by the Governor and, except as otherwise

1-15  provided in this section, selected in the following manner:


2-1  (a) One member who is a member of the faculty of the

2-2  University from a list of at least two names submitted by a

2-3  body of the University which represents the faculty of the

2-4  University;

2-5  (b) One member who is a student of the University from

2-6  a list of at least two names submitted by a body of the

2-7  University which represents the students of the University;

2-8  (c) One member from a list of at least two names

2-9  submitted by an organization or association which

2-10  represents licensed educational personnel in this state;

2-11      (d) One member from a list of at least two names

2-12  submitted by an organization or association which

2-13  represents parents of students in this state;

2-14      (e) One member from a list of at least two names

2-15  submitted by an organization or association which

2-16  represents women in this state or ethnic or racial minorities

2-17  in this state;

2-18      (f) One member from the general public who has

2-19  responsible administrative experience in public or business

2-20  administration or possesses broad management skills; and

2-21      (g) One member from the general public who is

2-22  qualified to practice public accounting pursuant to the laws

2-23  of this state.

2-24  If a body or organization fails to provide two names after a

2-25  request from the Governor, the Governor shall appoint a

2-26  member from the general public who has knowledge of

2-27  information relevant to such a body or organization failing

2-28  to provide such names.

2-29      3.  The Governor shall provide for the arrangement of

2-30  the terms of the Board of Regents so that an equal number

2-31  of terms, as nearly as may be, expire every 2 years. After the

2-32  initial terms and except as otherwise provided in this

2-33  subsection, each member of the Board of Regents shall

2-34  serve a term of 4 years, and until his successor is appointed

2-35  and qualified. A member of the Board of Regents appointed

2-36  pursuant to paragraph (b) of subsection 2 shall serve a term

2-37  of 2 years, and until his successor is appointed and

2-38  qualified. Any member of the Board of Regents may be

2-39  reappointed.

2-40      4.  A vacancy in the membership of the Board of

2-41  Regents must be filled in the same manner as the original

2-42  appointment for the remainder of the unexpired term.

2-43      5.  In appointing the members of the Board of Regents,

2-44  the Governor shall give consideration to appointing


3-1  members who represent urban and rural areas of this state,

3-2  women, and ethnic and racial minorities.

3-3  6.  Not more than four members of the Board of

3-4  Regents may be members of the same political party.

3-5  7.  The Legislature shall [at its regular session next

3-6  preceding the expiration of the term of Office of said Board

3-7  of Regents provide for the election of a new Board of Regents

3-8  and define their duties.] define the duties of the members of

3-9  the Board of Regents.

3-10  And be it further

3-11      Resolved, That the term of any member of the Board of

3-12  Regents who was elected or appointed before the first Monday of

3-13  the January following the approval and ratification of this

3-14  constitutional amendment by the people expires on that date. The

3-15  Governor shall appoint the members of the Board of Regents as

3-16  soon as practicable after that date, and in making those

3-17  appointments may appoint a former member of the Board of

3-18  Regents.

3-19  And be it further

3-20      Resolved, That this resolution becomes effective upon

3-21  passage.
