1-1  Assembly Joint RESOLUTION—Proposing to amend the Nevada Constitution to provide for the election of certain members of the Board of Regents and the gubernatorial appointment of certain members of the Board of Regents, and to specify the number and terms of the members.

 

1-2  Resolved by the Assembly and Senate of the State of

1-3  Nevada, Jointly, That Section 7 of Article 11 of the Nevada

1-4  Constitution be amended to read as follows:

1-5  [Sec: 7.  The Governor, Secretary of State, and

1-6  Superintendent of Public Instruction, shall for the first Four

1-7  Years and until their successors are elected and qualified

1-8  constitute]

1-9  Sec. 7.  1.  There is hereby created a Board of Regents

1-10  to control and manage the affairs of the University and the

1-11  funds of the same under such regulations as may be provided

1-12  by law. [But the]

1-13      2.  The Board of Regents consists of nine members.

1-14  Except as otherwise provided in this subsection, one

1-15  member must be elected from each congressional district in


2-1  this state and the remaining positions, if any, must be filled

2-2  by the Governor by appointment. If at any time this state is

2-3  apportioned more than nine congressional seats, the

2-4  Legislature shall provide for the districts from which the

2-5  nine members of the Board of Regents must be elected.

2-6  3.  The Legislature shall provide for the arrangement of

2-7  the terms of the elected members of the Board of Regents so

2-8  that an equal number of terms, as nearly as may be, expire

2-9  every 2 years. The Governor shall provide for the

2-10  arrangement of the terms of the appointed members of the

2-11  Board of Regents so that an equal number of terms, as

2-12  nearly as may be, expire every 2 years. After initial terms of

2-13  2 or 4 years to ensure staggered terms, each member of the

2-14  Board of Regents shall serve a term of 4 years, and until his

2-15  successor is elected and qualified or appointed and

2-16  qualified.

2-17      4.  If a vacancy occurs during the term of a member

2-18  appointed by the Governor, the Governor shall appoint a

2-19  person similarly qualified to replace that member for the

2-20  remainder of the unexpired term.

2-21      5.  In appointing the members of the Board of Regents,

2-22  the Governor shall:

2-23      (a) Appoint the members based on the qualifications for

2-24  appointment provided by the Legislature; and

2-25      (b) Give consideration to appointing members who

2-26  represent urban and rural areas of this state, women, and

2-27  ethnic and racial minorities.

2-28      6.  Not more than two-thirds of the appointed members

2-29  of the Board of Regents may be members of the same

2-30  political party.

2-31      7.  The Legislature shall [at its regular session next

2-32  preceding the expiration of the term of Office of said Board

2-33  of Regents] provide for the [election of a new] qualifications

2-34  of the members of the Board of Regents and define [their

2-35  duties.] the duties of the members of the Board of Regents.

2-36  And be it further

2-37      Resolved, That the term of any member of the Board of

2-38  Regents who was elected before November 4, 2008, expires on

2-39  January 5, 2009. The Governor shall make his appointments

2-40  pursuant to subsection 2 of Section 7 of Article 11 of the Nevada

2-41  Constitution as soon as practicable after January 5, 2009, and in

2-42  making those appointments may appoint a former member of the

2-43  Board of Regents.

2-44  And be it further


3-1  Resolved, That this resolution becomes effective on January 1,

3-2  2008, for purposes of nominating and electing members to the

3-3  Board of Regents from each congressional district, and on

3-4  January 5, 2009, for all other purposes.
