     Amend section 1, page 1, by deleting lines 4 through 10 and inserting:

shall not use any information included in the consumer credit report of an applicant or policyholder as a basis for determining:

     (a) Whether to issue, cancel or renew a policy;

     (b) The amount of the premium for a policy; or

     (c) Eligibility for any plan for making payments with regard to a policy.”.

     Amend section 1, page 2, by deleting line 1 and inserting:

     “3.  The provisions of this section must be liberally construed to protect applicants and policyholders by preventing the use of consumer credit reports in making determinations as set forth in subsection 1.

     4.  As used in this section, “consumer credit report” means any”.

     Amend section 1, page 2, by deleting lines 4 and 5 and inserting:

capacity or a credit transaction of a person; and”.

     Amend section 1, page 2, by deleting lines 7 and 8 and inserting:

a basis for a determination set forth in subsection 1.”.

     Amend the title of the bill to read as follows:

“AN ACT relating to insurance; prohibiting an insurer from using information included in the consumer credit report of an applicant or policyholder as a basis for making certain determinations regarding policies of insurance; and providing other matters properly relating thereto.”.

     Amend the summary of the bill to read as follows:

“SUMMARY—Prohibits insurer from using information included in consumer credit report of applicant or policyholder for certain purposes. (BDR 57-1114)”.
