AN ACT relating to psychiatrists; revising the requirements for certain licenses to practice medicine if the applicant intends to practice medicine at certain mental health centers under certain circumstances; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 630 of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 and 3 of this act.
1-3 Sec. 2. 1. The Division of Mental Health and
1-4 Developmental Services of the Department of Human Resources
1-5 may petition the Board to waive the requirement of a written or
1-6 oral examination, or both, pursuant to paragraph (e) of
1-7 subsection 2 of NRS 630.160 for an applicant who intends to
1-8 practice medicine with an emphasis in psychiatry in a mental
1-9 health center under the direct supervision of a medical director or
1-10 coordinator of medical programs, or a designee of a medical
1-11 director or coordinator of medical programs. The Board may
1-12 waive that requirement and issue the license if the applicant meets
2-1 all other conditions and requirements for a license to practice
2-2 medicine.
2-3 2. A person who is issued a license pursuant to this section
2-4 must be issued a license to practice medicine in this state that is
2-5 restricted to practicing in a mental health center under the direct
2-6 supervision of a medical director or coordinator of medical
2-7 programs, or a designee of a medical director or coordinator of
2-8 medical programs.
2-9 3. A person who is issued a restricted license pursuant to this
2-10 section may apply to the Board for renewal of that restricted
2-11 license every 2 years after being licensed.
2-12 4. The Division of Mental Health and Developmental
2-13 Services shall notify the Board when a person who is issued a
2-14 restricted license pursuant to this section ceases to practice
2-15 medicine with an emphasis in psychiatry in a mental health center
2-16 under the direct supervision of a medical director or coordinator
2-17 of medical programs, or a designee of a medical director or
2-18 coordinator of medical programs. Upon such notification, the
2-19 Board shall revoke the restricted license that was issued to the
2-20 person pursuant to this section.
2-21 5. A person who is issued a restricted license pursuant to this
2-22 section and who accepts the privilege of practicing medicine in
2-23 this state pursuant to the provisions of that license shall be deemed
2-24 to have given his consent to the revocation of that license at any
2-25 time by the Board for any of the grounds provided in NRS 630.161
2-26 or 630.301 to 630.3065, inclusive.
2-27 6. As used in this section:
2-28 (a) “Coordinator of medical programs” means a person
2-29 designated pursuant to NRS 433A.080.
2-30 (b) “Medical director” has the meaning ascribed to it in
2-31 NRS 433A.017.
2-32 (c) “Mental health center” has the meaning ascribed to it in
2-33 NRS 433.144.
2-34 Sec. 3. 1. The Division of Mental Health and
2-35 Developmental Services of the Department of Human Resources
2-36 may petition the Board to waive the requirement of a written or
2-37 oral examination, or both, pursuant to paragraph (e) of
2-38 subsection 2 of NRS 630.160 for an applicant for any of the
2-39 licenses issued pursuant to NRS 630.261 who intends to practice
2-40 medicine with an emphasis in psychiatry in a mental health center
2-41 under the direct supervision of a medical director or coordinator
2-42 of medical programs, or a designee of a medical director or
2-43 coordinator of medical programs. The Board may waive that
2-44 requirement and issue to the applicant the particular license
2-45 sought pursuant to NRS 630.261 if the applicant meets all other
3-1 conditions and requirements for the particular license sought
3-2 under the provisions of NRS 630.261.
3-3 2. A person who is issued any license pursuant to this section
3-4 must be issued a license to practice medicine in this state that is
3-5 restricted to practicing in a mental health center under the direct
3-6 supervision of a medical director or coordinator of medical
3-7 programs, or a designee of a medical director or coordinator of
3-8 medical programs, in addition to any restrictions, conditions or
3-9 qualifications imposed by NRS 630.261 upon that particular
3-10 license.
3-11 3. The Division of Mental Health and Developmental
3-12 Services shall notify the Board when a person who is issued any
3-13 license pursuant to this section ceases to practice medicine with an
3-14 emphasis in psychiatry in a mental health center under the direct
3-15 supervision of a medical director or coordinator of medical
3-16 programs, or a designee of a medical director or coordinator of
3-17 medical programs. Upon such notification, the Board shall revoke
3-18 the license that was issued to the person pursuant to this section.
3-19 4. A person who is issued any license pursuant to this section
3-20 and who accepts the privilege of practicing medicine in this state
3-21 pursuant to the provisions of that license shall be deemed to have
