AN ACT relating to persons with disabilities; establishing a Legislative Committee on Persons With Disabilities; prescribing the powers and duties of the Committee; requiring the Department of Human Resources to submit certain reports to the Committee; providing for the prospective expiration of the Committee; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 218 of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 to 8, inclusive, of this
1-3 act.
1-4 Sec. 2. As used in sections 2 to 8, inclusive, of this act,
1-5 “Committee” means the Legislative Committee on Persons With
1-6 Disabilities.
1-7 Sec. 3. 1. There is hereby established a Legislative
1-8 Committee on Persons With Disabilities consisting of three
1-9 members of the Senate and three members of the Assembly,
1-10 appointed by the Legislative Commission. The members must be
2-1 appointed with appropriate regard for their experience with and
2-2 knowledge of matters relating to persons with disabilities.
2-3 2. The members of the Committee shall select a Chairman
2-4 and a Vice Chairman from among their members. The Chairman
2-5 must be elected from one house of the Legislature and the Vice
2-6 Chairman from the other house. After the initial selection of a
2-7 Chairman and a Vice Chairman, each of those officers holds
2-8 office for a term of 2 years commencing on July 1 of each
2-9 odd-numbered year. If a vacancy occurs in the chairmanship or
2-10 vice chairmanship, the members of the Committee shall select a
2-11 replacement for the remainder of the unexpired term.
2-12 3. Any member of the Committee who is not a candidate for
2-13 reelection or who is defeated for reelection continues to serve until
2-14 the next session of the Legislature convenes.
2-15 4. Vacancies on the Committee must be filled in the same
2-16 manner as original appointments.
2-17 Sec. 4. 1. The members of the Committee shall meet
2-18 throughout each year at the times and places specified by a call of
2-19 the Chairman or a majority of the Committee.
2-20 2. The Director of the Legislative Counsel Bureau or his
2-21 designee shall act as the nonvoting recording Secretary.
2-22 3. The Committee shall prescribe regulations for its own
2-23 management and government.
2-24 4. Except as otherwise provided in subsection 5, four
2-25 members of the Committee constitute a quorum, and a quorum
2-26 may exercise all the powers conferred on the Committee.
2-27 5. Any recommended legislation proposed by the Committee
2-28 must be approved by a majority of the members of the Senate and
2-29 by a majority of the members of the Assembly appointed to the
2-30 Committee.
2-31 6. Except during a regular or special session of the
2-32 Legislature, the members of the Committee are entitled to receive
2-33 the compensation provided for a majority of the members of the
2-34 Legislature during the first 60 days of the preceding regular
2-35 session, the per diem allowance provided for state officers and
2-36 employees generally and the travel expenses provided pursuant to
2-37 NRS 218.2207 for each day or portion of a day of attendance at a
2-38 meeting of the Committee and while engaged in the business of
2-39 the Committee. The salaries and expenses paid pursuant to this
2-40 subsection and the expenses of the Committee must be paid from
2-41 the Legislative Fund.
2-42 Sec. 5. The Committee may:
2-43 1. Study and comment on issues related to persons with
2-44 disabilities in this state, including, without limitation:
3-1 (a) Programs for the provision of services to persons with
3-2 disabilities in this state;
3-3 (b) Methods to enhance such programs and to ensure that
3-4 persons with disabilities are receiving services in the most
3-5 appropriate setting;
3-6 (c) Federal and state laws concerning persons with disabilities;
3-7 (d) The availability of useful information and data as needed
3-8 for the State of Nevada to effectively make decisions, plan budgets
3-9 and monitor costs and outcomes of services provided to persons
3-10 with disabilities;
3-11 (e) Methods to increase the availability of such information
3-12 and data;
3-13 (f) Compliance with federal requirements which affect persons
3-14 with disabilities; and
3-15 (g) Any other matters that, in the determination of the
3-16 Committee, affect persons with disabilities.
3-17 2. Conduct investigations and hold hearings in connection
3-18 with its powers pursuant to this section.
3-19 3. Direct the Legislative Counsel Bureau to assist in the study
3-20 of issues related to persons with disabilities in this state.
3-21 4. Recommend to the Legislature, as a result of its study, any
3-22 appropriate legislation.
3-23 Sec. 6. 1. In conducting the investigations and hearings of
3-24 the Committee:
3-25 (a) The Secretary of the Committee or, in his absence, any
3-26 member of the Committee may administer oaths.
3-27 (b) The Secretary or Chairman of the Committee may cause
3-28 the deposition of witnesses, residing either within or outside of the
3-29 State, to be taken in the manner prescribed by rule of court for
3-30 taking depositions in civil actions in the district courts.
3-31 (c) The Chairman of the Committee may issue subpoenas to
3-32 compel the attendance of witnesses and the production of books
3-33 and papers.
3-34 2. If any witness refuses to attend or testify or produce any
3-35 books and papers as required by the subpoena, the Chairman of
3-36 the Committee may report to the district court by petition, setting
3-37 forth that:
3-38 (a) Due notice has been given of the time and place of
3-39 attendance of the witness or the production of the books and
3-40 papers;
3-41 (b) The witness has been subpoenaed by the Committee
3-42 pursuant to this section; and
3-43 (c) The witness has failed or refused to attend or produce the
3-44 books and papers required by the subpoena before the Committee
4-1 which is named in the subpoena, or has refused to answer
4-2 questions propounded to him,
4-3 and asking for an order of the court compelling the witness to
4-4 attend and testify or produce the books and papers before the
4-5 Committee.
4-6 3. Upon such a petition, the court shall enter an order
4-7 directing the witness to appear before the court at a time and place
4-8 to be fixed by the court in its order, the time to be not more than
4-9 10 days after the date of the order, and to show cause why he has
4-10 not attended or testified or produced the books or papers before
4-11 the Committee. A certified copy of the order must be served upon
4-12 the witness.
4-13 4. If it appears to the court that the subpoena was regularly
4-14 issued by the Committee, the court shall enter an order that the
4-15 witness appear before the Committee at the time and place fixed in
4-16 the order and testify or produce the required books or papers.
4-17 Failure to obey the order constitutes contempt of court.
4-18 Sec. 7. Each witness who appears before the Committee by
4-19 its order, except a state officer or employee, is entitled to receive
4-20 for his attendance the fees and mileage provided for witnesses in
4-21 civil cases in the courts of record of this state. The fees and
4-22 mileage must be audited and paid upon the presentation of proper
4-23 claims sworn to by the witness and approved by the Secretary and
4-24 Chairman of the Committee.
4-25 Sec. 7.5 1. There is hereby established an advisory
4-26 committee to the Committee consisting of:
4-27 (a) The Superintendent of Public Instruction;
4-28 (b) The Administrator of the Aging Services Division of the
4-29 Department of Human Resources;
4-30 (c) The Chief of the Bureau of Vocational Rehabilitation of
4-31 the Rehabilitation Division of the Department of Employment,
4-32 Training and Rehabilitation;
4-33 (d) The Chief of the Bureau of Services to the Blind and
4-34 Visually Impaired of the Rehabilitation Division of the
4-35 Department of Employment, Training and Rehabilitation; and
4-36 (e) Any persons appointed by the Chairman of the Committee
4-37 pursuant to subsection 2.
4-38 2. The Chairman of the Committee shall appoint
4-39 representatives from local advocacy and provider groups to serve
4-40 on the advisory committee, as the Chairman deems necessary.
4-41 3. Each member of the advisory committee described in
4-42 paragraph (a), (b), (c) or (d) of subsection 1 may designate a
4-43 representative to serve in his place on the advisory committee or to
4-44 replace him at a meeting of the Committee or the advisory
4-45 committee.
5-1 4. Each member of the advisory committee who is not an
5-2 officer or employee of the State serves without compensation and
5-3 is not entitled to receive a per diem allowance or travel expenses.
5-4 5. Each member of the advisory committee who is an officer
5-5 or employee of the State must be relieved from his duties without
5-6 loss of his regular compensation so that he may attend meetings of
5-7 the Committee or the advisory committee and is entitled to receive
5-8 the per diem allowance and travel expenses provided for state
5-9 officers and employees generally, which must be paid by the state
5-10 agency that employs him.
5-11 Sec. 8. On or before July 1 of each even-numbered year or
5-12 October 1 of each odd-numbered year, the Department of Human
5-13 Resources shall submit a report to the Committee. The report must
5-14 include, without limitation, information relating to:
5-15 1. The expansion of the program established pursuant to
5-16 NRS 422.2715;
5-17 2. The progress made by the Department toward the goal of
5-18 equitably providing, by January 1, 2008, comprehensive health
5-19 care coverage to each person with a disability who by virtue of
5-20 becoming employed has established an income that is above the
5-21 federally designated level signifying poverty and who is unable to
5-22 obtain the health insurance coverage he needs from a source other
5-23 than a program of public assistance; and
5-24 3. The impact of assessments made of persons with
5-25 disabilities pursuant to the comprehensive long-term Strategic
5-26 Plan for Persons with Disabilities prepared by the Task Force on
5-27 Disability to determine if they are living in an unnecessarily
5-28 restrictive residential environment, including, without limitation,
5-29 any savings in costs that resulted from those assessments.
5-30 Sec. 9. 1. The Department of Human Resources shall
5-31 examine the feasibility of amending the State Plan for Medicaid to
5-32 authorize money to be paid as Medicaid benefits to cover the costs
5-33 of community-based services for a person if:
5-34 (a) The person is assessed and determined to be living in an
5-35 unnecessarily restrictive residential environment;
5-36 (b) The person relocates from a facility for skilled nursing or a
5-37 facility for intermediate care to a community-based setting; and
5-38 (c) Money paid as Medicaid benefits was used to cover the costs
5-39 of the care of that person while the person resided in the facility for
5-40 skilled nursing or the facility for intermediate care.
5-41 2. On or before July 1, 2004, the Department shall submit to
5-42 the Legislative Committee on Persons With Disabilities a report
5-43 relating to the results of the examination conducted pursuant to
5-44 subsection 1.
5-45 3. As used in this section:
6-1 (a) “Facility for intermediate care” has the meaning ascribed to
6-2 it in NRS 449.0038.
6-3 (b) “Facility for skilled nursing” has the meaning ascribed to it
6-4 in NRS 449.0039.
6-5 Sec. 10. 1. The Legislative Committee on Persons With
6-6 Disabilities shall conduct a study for the purpose of establishing an
6-7 Interagency Transition Plan concerning the transition from school to
6-8 work for pupils with disabilities and to study ways to more fully
6-9 implement the Americans with Disabilities Act of 1990, 42 U.S.C.
6-10 §§ 12101 et seq., in Nevada and to study the facilitation of the use
6-11 of service animals in this state.
6-12 2. The study must, without limitation:
6-13 (a) Include a review of programs available for pupils with
6-14 disabilities in the secondary school environment, including a review
6-15 of the outcomes for such pupils after exiting school, as a means of
6-16 determining costs and potential savings for such programs;
6-17 (b) Identify gaps in services that may exist for pupils with
6-18 disabilities who are transitioning out of school into the workforce
6-19 and develop strategies for narrowing these gaps, including
6-20 postsecondary education, vocational training, integrated
6-21 employment, continuing and adult education, adult services,
6-22 independent living and community participation; and
6-23 (c) Determine ways of better implementing the provisions of the
6-24 Individuals with Disabilities Education Act, 20 U.S.C. §§ 1400
6-25 et seq., and the Americans with Disabilities Act, 42 U.S.C. §§
6-26 12101 et seq., for the benefit of the residents of the State of Nevada,
6-27 including appropriate access for persons with disabilities and
6-28 facilitating the use of service animals.
6-29 3. The Legislative Committee on Persons With Disabilities
6-30 shall establish an Interagency Transition Plan for the purpose of
6-31 facilitating the transition from school to work for pupils with
6-32 disabilities.
6-33 4. The Legislative Committee on Persons With Disabilities
6-34 shall submit a copy of the Interagency Transition Plan established
6-35 pursuant to subsection 3 and a report of the results of the study
6-36 conducted pursuant to subsection 1 and any recommendations for
6-37 legislation to the 73rd Session of the Nevada Legislature.
6-38 Sec. 11. This act becomes effective on July 1, 2003, and
6-39 expires by limitation on June 30, 2007.
6-40 H
