AN ACT relating to air pollution; requiring the Department of Motor Vehicles to establish by regulation procedures for inspecting certain stations involved in the control of emissions from engines; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. NRS 445B.790 is hereby amended to read as
1-2 follows:
1-3 445B.790 1. The Department of Motor Vehicles shall , by
1-4 regulation, establish procedures for inspecting authorized inspection
1-5 stations, authorized maintenance stations, authorized stations and
1-6 fleet stations, and may require the holder of a license for an
1-7 authorized inspection station, authorized maintenance station,
1-8 authorized station or fleet station to submit any material or
1-9 document which is used in the program to control emissions from
1-10 motor vehicles.
1-11 2. The Department may deny, suspend or revoke the license of
1-12 an approved inspector, authorized inspection station, authorized
1-13 maintenance station, authorized station or fleet station if:
1-14 (a) The approved inspector or the holder of a license for an
1-15 authorized inspection station, authorized maintenance station,
2-1 authorized station or fleet station is not complying with the
2-2 provisions of NRS 445B.700 to 445B.815, inclusive.
2-3 (b) The holder of a license for an authorized inspection station,
2-4 authorized maintenance station, authorized station or fleet station
2-5 refuses to furnish the Department with the requested material or
2-6 document.
2-7 (c) The approved inspector has issued a fraudulent certificate of
2-8 compliance, whether intentionally or negligently. A “fraudulent
2-9 certificate” includes, but is not limited to:
2-10 (1) A backdated certificate;
2-11 (2) A postdated certificate; and
2-12 (3) A certificate issued without an inspection.
2-13 (d) The approved inspector does not follow the prescribed test
2-14 procedure.
