AN ACT relating to public employees; making certain provisions apply retroactively to allow certain benefits to be made available to the surviving spouses and children of certain police officers and firemen killed in the line of duty; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Section 7 of chapter 506, Statutes of Nevada 1999,
1-2 at page 2610, is hereby amended to read as follows:
1-3 Sec. 7. This act becomes effective upon passage and
1-4 approval[.] and applies retroactively to January 1, 1998.
1-5 Sec. 2. Notwithstanding the provisions of NRS 287.021 or
1-6 287.0477 concerning notice, if a surviving spouse or child who was
1-7 not eligible for the benefits set forth in NRS 287.021 or 287.0477
1-8 before the effective date of this act becomes eligible for those
1-9 benefits by the retroactive operation of the amendatory provisions of
1-10 section 1 of this act, the surviving spouse or child must notify in
1-11 writing the public agency, the participating public agency or the
1-12 Board of the Public Employees’ Benefits Program, as appropriate
1-13 under NRS 287.021 or 287.0477, not later than 60 days after the
1-14 effective date of this act to be entitled to the benefits set forth in
1-15 NRS 287.021 or 287.0477.
2-1 Sec. 3. 1. If a public agency is required pursuant to NRS
2-2 287.021 and the amendatory provisions of section 1 of this act to
2-3 pay the entire cost of the premiums or contributions for the group
2-4 insurance or medical and hospital service for a surviving spouse or
2-5 child who notifies the public agency pursuant to section 2 of this act,
2-6 the public agency is not required to:
2-7 (a) Reimburse the surviving spouse or child for any payments
2-8 made by or on behalf of the surviving spouse or child between
2-9 January 1, 1998, and the effective date of this act for the group
2-10 insurance or medical and hospital service; or
2-11 (b) Pay or reimburse the surviving spouse or child for any
2-12 medical expenses incurred by or on behalf of the surviving spouse
2-13 or child between January 1, 1998, and the effective date of this act.
2-14 2. If a participating public agency is required pursuant to NRS
2-15 287.0477 and the amendatory provisions of section 1 of this act to
2-16 pay the entire cost of the premiums or contributions for the Public
2-17 Employees’ Benefits Program or any other insurer or employee
2-18 benefit plan approved by the Board of the Public Employees’
2-19 Benefits Program pursuant to NRS 287.0479 for a surviving spouse
2-20 or child who meets the requirements set forth in subsection 1 of
2-21 NRS 287.0477 and who notifies the participating public agency
2-22 pursuant to section 2 of this act, the participating public agency is
2-23 not required to:
2-24 (a) Reimburse the surviving spouse or child for any payments
2-25 made by or on behalf of the surviving spouse or child between
2-26 January 1, 1998, and the effective date of this act for the Public
2-27 Employees’ Benefits Program or any other insurer or employee
2-28 benefit plan approved by the Board of the Public Employees’
2-29 Benefits Program pursuant to NRS 287.0479; or
2-30 (b) Pay or reimburse the surviving spouse or child for any
2-31 medical expenses incurred by or on behalf of the surviving spouse
2-32 or child between January 1, 1998, and the effective date of this act.
2-33 3. If the State of Nevada is required pursuant to NRS 287.0477
2-34 and the amendatory provisions of section 1 of this act to pay the
2-35 entire cost of the premiums or contributions for the Public
2-36 Employees’ Benefits Program for a surviving spouse or child who
2-37 elects to join the Public Employees’ Benefits Program pursuant to
2-38 subsection 2 of NRS 287.0477 and who notifies the Board of the
2-39 Public Employees’ Benefits Program pursuant to section 2 of this
2-40 act, the State of Nevada is not required to:
2-41 (a) Reimburse the surviving spouse or child for any payments
2-42 made by or on behalf of the surviving spouse or child between
2-43 January 1, 1998, and the effective date of this act for the Public
2-44 Employees’ Benefits Program; or
3-1 (b) Pay or reimburse the surviving spouse or child for any
3-2 medical expenses incurred by or on behalf of the surviving spouse
3-3 or child between January 1, 1998, and the effective date of this act.
3-4 Sec. 4. This act becomes effective upon passage and approval.
