AN ACT relating to dentistry; revising the requirements for the issuance of a limited license to practice dentistry or dental hygiene; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 631.271 is hereby amended to read as follows:

1-2  631.271  1.  The Board shall, without a clinical demonstration

1-3  required by NRS 631.240 or a practical examination required by

1-4  NRS 631.300, issue a limited license to practice dentistry or dental

1-5  hygiene to a person who:

1-6  (a) [At the time of his application, has a license to practice

1-7  dentistry or dental hygiene issued pursuant to the laws of another

1-8  state or the District of Columbia;

1-9  (b) Is otherwise] Is qualified for a license to practice dentistry or

1-10  dental hygiene in this state;

1-11      [(c)] (b) Pays the required application fee; and

1-12      [(d)] (c) Has entered into a contract with the University and

1-13  Community College System of Nevada to provide services as a

1-14  dental intern, dental resident or instructor of dentistry or dental

1-15  hygiene at an educational or outpatient clinic, hospital or other


2-1  facility of the University and Community College System of

2-2  Nevada.

2-3  2.  The Board shall not issue a limited license to a person:

2-4  (a) [Whose] Who has been issued a license to practice dentistry

2-5  or dental hygiene if:

2-6       (1) The person is involved in a disciplinary action

2-7  concerning the license; or

2-8       (2) The license has been revoked or suspended; or

2-9  (b) Who has been refused a license [or is involved in a

2-10  disciplinary action concerning his license] to practice dentistry or

2-11  dental hygiene,

2-12  in this state, another state or territory of the United States, or the

2-13  District of Columbia.

2-14      3.  A person to whom a limited license is issued pursuant to

2-15  subsection 1:

2-16      (a) May practice dentistry or dental hygiene in this state only:

2-17          (1) At the educational or outpatient clinic, hospital or other

2-18  facility where he is employed; and

2-19          (2) In accordance with the contract required by paragraph

2-20  [(d)] (c) of subsection 1.

2-21      (b) Shall not, for the duration of the limited license, engage in

2-22  the private practice of dentistry or dental hygiene in this state or

2-23  accept compensation for the practice of dentistry or dental hygiene

2-24  except such compensation as may be paid to him by the University

2-25  and Community College System of Nevada for services provided as

2-26  a dental intern, dental resident or instructor of dentistry or dental

2-27  hygiene.

2-28      [(c) May have his license to practice dentistry or dental hygiene

2-29  issued pursuant to the laws of another state or the District of

2-30  Columbia placed on inactive status.]

2-31      4.  A limited license expires 1 year after its date of issuance and

2-32  may be renewed on or before the date of its expiration. The holder

2-33  of a limited license may, upon compliance with the requirements set

2-34  forth in subsection 2 of NRS 631.330 and the completion of a

2-35  review conducted at the discretion of the Board, be granted a

2-36  renewal certificate that authorizes the continuation of practice

2-37  pursuant to the limited license for 1 year.

2-38      5.  Within 7 days after the termination of his contract required

2-39  by paragraph [(d)] (c) of subsection 1, the holder of a limited license

2-40  shall notify the Board of the termination, in writing, and surrender

2-41  the limited license to the Board.

2-42      6.  The Board may revoke a limited license at any time upon

2-43  proof satisfactory to the Board that the holder of the license violated

2-44  any provision of this chapter or the regulations of the Board.

 


3-1  Sec. 2.  This act becomes effective upon passage and approval.
