AN ACT relating to industrial insurance; directing the Legislative Commission to appoint a subcommittee to study the impacts of the recent privatization of the industrial insurance program; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  The Legislative Commission shall appoint a

1-2  subcommittee consisting of six Legislators to conduct an interim

1-3  study of the impact of the recent privatization of the industrial

1-4  insurance program on injured workers, employers and insurers. The

1-5  Legislative Commission shall appoint to the subcommittee three

1-6  members of the Senate and three members of the Assembly who are

1-7  acquainted with the statutory program for industrial insurance in this

1-8  state.

1-9  2.  The study must include, without limitation:

1-10      (a) An examination of the procedures for resolving contested

1-11  industrial insurance claims filed by injured workers, the costs to

1-12  injured workers, employers and insurers in litigating such claims,

1-13  and the timeliness of resolving such claims;

1-14      (b) Consideration of whether it is appropriate to reimburse

1-15  injured workers for time off of work when they are receiving


2-1  medical treatment for compensable industrial injuries or illnesses,

2-2  including the cost of such reimbursement to employers and insurers

2-3  and the impacts on injured workers of not making such

2-4  reimbursement; and

2-5  (c) A review of any other issues or subjects concerning the

2-6  impacts of the recent privatization of the industrial insurance

2-7  program on injured workers, employers and insurers.

2-8  3.  In conducting the study, the subcommittee shall seek

2-9  information and suggestions from various representatives of injured

2-10  workers, employers and insurers and from experts in the area of

2-11  industrial insurance.

2-12      4.  Any recommended legislation proposed by the

2-13  subcommittee must be approved by a majority of the members of

2-14  the Senate and a majority of the members of the Assembly who are

2-15  appointed to the subcommittee.

2-16      5.  The Legislative Commission shall submit a report of the

2-17  results of the study and any recommendations for legislation to the

2-18  73rd Session of the Nevada Legislature.

2-19      Sec. 2.  This act becomes effective on July 1, 2003.
