AN ACT relating to motor vehicles; authorizing the Department of Motor Vehicles to establish a program to contract with persons to provide certain services relating to the registration of motor vehicles otherwise required to be provided by the Department; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. Chapter 482 of NRS is hereby amended by adding
1-2 thereto the provisions set forth as sections 2 and 3 of this act.
1-3 Sec. 2. “Contracted agent” means a person who is
1-4 authorized to register motor vehicles, issue certificates of
1-5 registration and renew the registration of a motor vehicle
1-6 pursuant to section 3 of this act. The term does not include a
1-7 registered dealer, authorized inspection station, authorized station,
1-8 a county assessor or other governmental agency.
1-9 Sec. 3. 1. Upon request, the Department may authorize a
1-10 person to:
1-11 (a) Accept applications for the registration and renewal of
1-12 registration of motor vehicles, and collect related fees and taxes;
1-13 (b) Issue certificates of registration to applicants who satisfy
1-14 the requirements of this chapter; and
2-1 (c) Accept applications for the transfer of registration
2-2 pursuant to NRS 482.399.
2-3 2. A person who is authorized to register motor vehicles, issue
2-4 certificates of registration and renew the registration of a motor
2-5 vehicle pursuant to subsection 1 shall:
2-6 (a) Transmit the applications he receives to the Department
2-7 within the period prescribed by the Department;
2-8 (b) Except with respect to a fee authorized by subsection 3,
2-9 transmit any fees or taxes he collects from the applicants and
2-10 properly account for them within the period prescribed by the
2-11 Department;
2-12 (c) Comply with the regulations adopted pursuant to
2-13 subsection 5;
2-14 (d) Bear any cost of equipment which is necessary to issue
2-15 certificates of registration or renew the registration of a motor
2-16 vehicle, including any computer hardware or software; and
2-17 (e) Provide for any fee, bond or insurance which is necessary
2-18 to carry out the provisions of sections 2 and 3 of this act.
2-19 3. In addition to any fees or taxes collected pursuant to this
2-20 section, a person who is authorized to register motor vehicles,
2-21 issue certificates of registration and renew the registration of a
2-22 motor vehicle pursuant to subsection 1 may charge and collect a
2-23 fee for the performance of services pursuant to this section.
2-24 4. A person who is authorized to register motor vehicles, issue
2-25 certificates of registration and renew the registration of a motor
2-26 vehicle pursuant to subsection 1 may not receive compensation
2-27 from the Department for the performance of services pursuant to
2-28 this section.
2-29 5. The Director shall adopt such regulations as the Director
2-30 determines are necessary to carry out the provisions of this
2-31 section.
2-32 Sec. 4. NRS 482.010 is hereby amended to read as follows:
2-33 482.010 As used in this chapter, unless the context otherwise
2-34 requires, the words and terms defined in NRS 482.011 to 482.137,
2-35 inclusive, and section 2 of this act, have the meanings ascribed to
2-36 them in those sections.
2-37 Sec. 5. NRS 482.160 is hereby amended to read as follows:
2-38 482.160 1. The Director may adopt and enforce such
2-39 administrative regulations as are necessary to carry out the
2-40 provisions of this chapter.
2-41 2. The Director may establish branch offices as provided in
2-42 NRS 481.055, and may by contract appoint any person or public
2-43 agency as an agent to assist in carrying out the duties of the
2-44 Department pursuant to this chapter. The Director may designate
2-45 the county assessor of any county as agent to assist in carrying out
3-1 the duties of the Department in that county. The county assessor
3-2 may, under an agreement with the Department made pursuant to this
3-3 subsection, transfer his duties as agent to the Department where the
3-4 Department has established a branch office, consisting of full-time
3-5 employees, in his county.
3-6 3. Except as otherwise provided in [this subsection,]
3-7 subsection 4 or 5, the contract with each agent appointed by the
3-8 Department in connection with the registration of motor vehicles
3-9 and issuance of license plates must provide for compensation based
3-10 upon the reasonable value of the services of the agent but must not
3-11 exceed $2 for each registration.
3-12 4. An authorized inspection station or authorized station that
3-13 issues certificates of registration pursuant to NRS 482.281 is not
3-14 entitled to receive compensation from the Department pursuant to
3-15 [this subsection.] subsection 3.
3-16 5. A contracted agent that issues certificates of registration
3-17 pursuant to section 3 of this act is not entitled to receive
3-18 compensation from the Department pursuant to subsection 3.
3-19 Sec. 6. NRS 482.175 is hereby amended to read as follows:
3-20 482.175 The Department and the officers and deputies thereof ,
3-21 [and] registered dealers and contracted agents shall examine and to
3-22 the best of their ability determine the genuineness and regularity of
3-23 every registration and transfer of registration of a vehicle as
3-24 provided in this chapter, in order that every certificate issued for a
3-25 vehicle must contain true statements of the ownership thereof, and
3-26 to prevent the registration of a vehicle by any person not entitled
3-27 thereto. The Department , [or] a registered dealer or contracted
3-28 agent may require any applicant to furnish such information in
3-29 addition to that contained in the application as may be necessary to
3-30 satisfy the Department of the truth and regularity of the application.
3-31 Sec. 7. NRS 482.205 is hereby amended to read as follows:
3-32 482.205 Except as otherwise provided in this chapter, every
3-33 owner of a motor vehicle, trailer or semitrailer intended to be
3-34 operated upon any highway in this state shall, before the motor
3-35 vehicle, trailer or semitrailer can be operated, apply to the
3-36 Department , [or] a registered dealer or contracted agent for and
3-37 obtain the registration thereof.
3-38 Sec. 8. NRS 482.206 is hereby amended to read as follows:
3-39 482.206 1. Except as otherwise provided in this section,
3-40 every motor vehicle, except for a motor vehicle that is registered
3-41 pursuant to the provisions of NRS 706.801 to 706.861, inclusive, or
3-42 which is a motor vehicle with a declared gross weight in excess of
3-43 26,000 pounds, must be registered for a period of 12 consecutive
3-44 months beginning the day after the first registration by the owner in
3-45 this state.
4-1 2. Every vehicle registered by an agent of the Department , [or]
4-2 a registered dealer or contracted agent must be registered for 12
4-3 consecutive months beginning the first day of the month after the
4-4 first registration by the owner in this state.
4-5 3. Upon the application of the owner of a fleet of vehicles, the
4-6 Director may permit him to register his fleet on the basis of a
4-7 calendar year.
4-8 4. When the registration of any vehicle is transferred pursuant
4-9 to the provisions of NRS 482.3667[, 482.379] or 482.399, the
4-10 expiration date of each regular license plate, special license plate or
4-11 substitute decal must, at the time of the transfer of registration, be
4-12 advanced for a period of 12 consecutive months beginning:
4-13 (a) The first day of the month after the transfer, if the vehicle is
4-14 transferred by an agent of the Department; or
4-15 (b) The day after the transfer in all other cases,
4-16 and a credit on the portion of the fee for registration and the
4-17 governmental services tax attributable to the remainder of
4-18 the current period of registration allowed pursuant to the applicable
4-19 provisions of NRS 482.3667[, 482.379] and 482.399.
4-20 Sec. 9. NRS 482.215 is hereby amended to read as follows:
4-21 482.215 1. All applications for registration, except
4-22 applications for renewal of registration, must be made as provided in
4-23 this section.
4-24 2. Except as otherwise provided in NRS 482.294, applications
4-25 for all registrations, except renewals of registration, must be made in
4-26 person, if practicable, to any office or agent of the Department , [or
4-27 to] a registered dealer[.] or contracted agent.
4-28 3. Each application must be made upon the appropriate form
4-29 furnished by the Department and contain:
4-30 (a) The signature of the owner, except as otherwise provided in
4-31 subsection 2 of NRS 482.294, if applicable.
4-32 (b) His residential address.
4-33 (c) His declaration of the county where he intends the vehicle to
4-34 be based, unless the vehicle is deemed to have no base. The
4-35 Department shall use this declaration to determine the county to
4-36 which the governmental services tax is to be paid.
4-37 (d) A brief description of the vehicle to be registered, including
4-38 the name of the maker, the engine, identification or serial number,
4-39 whether new or used, and the last license number, if known, and the
4-40 state in which it was issued, and upon the registration of a new
4-41 vehicle, the date of sale by the manufacturer or franchised and
4-42 licensed dealer in this state for the make to be registered to the
4-43 person first purchasing or operating the vehicle.
4-44 (e) Proof satisfactory to the Department , [or] registered dealer
4-45 or contracted agent that the applicant has provided the insurance
5-1 required by NRS 485.185 and, except as otherwise provided in this
5-2 paragraph, his signed declaration that he will maintain the insurance
5-3 during the period of registration. If the application is submitted by
5-4 electronic means pursuant to NRS 482.294, the applicant is not
5-5 required to sign the declaration required by this paragraph.
5-6 (f) If the insurance is provided by a contract of insurance,
5-7 evidence of that insurance provided by the insurer in the form of:
5-8 (1) A certificate of insurance on a form approved by the
5-9 Commissioner of Insurance; or
5-10 (2) A card issued pursuant to NRS 690B.023 which identifies
5-11 the vehicle and indicates, at the time of application for registration,
5-12 coverage which meets the requirements of NRS 485.185.
5-13 The Department may file that evidence, return it to the applicant or
5-14 otherwise dispose of it.
5-15 (g) If required, evidence of the applicant’s compliance with
5-16 controls over emission.
5-17 4. The application must contain such other information as is
5-18 required by the Department , [or] registered dealer[,] or contracted
5-19 agent and must be accompanied by proof of ownership satisfactory
5-20 to the Department.
5-21 5. For purposes of the proof, declaration and evidence required
5-22 by paragraphs (e) and (f) of subsection 3:
5-23 (a) Vehicles which are subject to the fee for a license and the
5-24 requirements of registration of the Interstate Highway User Fee
5-25 Apportionment Act, and which are based in this state, may be
5-26 declared as a fleet by the registered owner thereof, on his original
5-27 application for or application for renewal of a proportional
5-28 registration. The owner may file a single certificate of insurance
5-29 covering that fleet.
5-30 (b) Other fleets composed of 10 or more vehicles based in this
5-31 state or vehicles insured under a blanket policy which does not
5-32 identify individual vehicles may each be declared annually as a fleet
5-33 by the registered owner thereof for the purposes of an application
5-34 for his original or any renewed registration. The owner may file a
5-35 single certificate of insurance covering that fleet.
5-36 (c) A person who qualifies as a self-insurer pursuant to the
5-37 provisions of NRS 485.380 may file a copy of his certificate of self-
5-38 insurance.
5-39 (d) A person who qualifies for an operator’s policy of liability
5-40 insurance pursuant to the provisions of NRS 485.186 and 485.3091
5-41 may file evidence of that insurance.
5-42 Sec. 10. NRS 482.230 is hereby amended to read as follows:
5-43 482.230 The Department , [or] a registered dealer or
5-44 contracted agent shall not grant an application for the registration of
5-45 a vehicle in any of the following events:
6-1 1. When the applicant [therefor] is not entitled [thereto] to
6-2 register the vehicle pursuant to the provisions of this chapter.
6-3 2. When the applicant has neglected or refused to furnish the
6-4 Department , [or] registered dealer or contracted agent with the
6-5 information required in the appropriate official form or reasonable
6-6 additional information required by the Department , [or] registered
6-7 dealer[.] or contracted agent.
6-8 3. When the fees required [therefor] by law for the registration
6-9 of the vehicle have not been paid.
6-10 Sec. 11. NRS 482.235 is hereby amended to read as follows:
6-11 482.235 1. The Department shall file each application
6-12 received and register the vehicle therein described and the owner
6-13 thereof in suitable books or on index cards as follows:
6-14 (a) Under a distinctive registration number assigned to the
6-15 vehicle and to the owner thereof, referred to in this chapter as the
6-16 registration number.
6-17 (b) Alphabetically under the legal name of the owner.
6-18 (c) Numerically under the serial or vehicle identification number
6-19 of the vehicle or a permanent identifying number, as may be
6-20 determined by the Department.
6-21 2. A registered dealer or contracted agent who registers a
6-22 vehicle shall assign a registration number for that vehicle according
6-23 to a list of registration numbers issued by the Department for use by
6-24 that registered dealer[.] or contracted agent.
6-25 Sec. 12. NRS 482.240 is hereby amended to read as follows:
6-26 482.240 1. Upon a registration of a vehicle, the Department ,
6-27 [or] a registered dealer or contracted agent shall issue a certificate
6-28 of registration to the owner.
6-29 2. When an applicant for registration or transfer of registration
6-30 is unable, for any reason, to submit to the Department in support of
6-31 the application for registration, or transfer of registration, such
6-32 documentary evidence of legal ownership as, in the opinion of the
6-33 Department, is sufficient to establish the legal ownership of the
6-34 vehicle concerned in the application for registration or transfer of
6-35 registration, the Department may issue to the applicant only a
6-36 certificate of registration.
6-37 3. The Department may, upon proof of ownership satisfactory
6-38 to it, issue a certificate of ownership before the registration of the
6-39 vehicle concerned. The certificate of registration issued pursuant to
6-40 this chapter is valid only during the registration period or calendar
6-41 year for which it is issued, and a certificate of ownership is valid
6-42 until cancelled by the Department upon the transfer of interest
6-43 therein.
7-1 Sec. 13. NRS 482.260 is hereby amended to read as follows:
7-2 482.260 1. When registering a vehicle, the Department and
7-3 its agents or a registered dealer or contracted agent shall:
7-4 (a) Collect the fees for license plates and registration as
7-5 provided for in this chapter.
7-6 (b) Collect the governmental services tax on the vehicle, as
7-7 agent for the county where the applicant intends to base the vehicle
7-8 for the period of registration, unless the vehicle is deemed to have
7-9 no base.
7-10 (c) Collect the applicable taxes imposed pursuant to chapters
7-11 372, 374, 377 and 377A of NRS.
7-12 (d) Issue a certificate of registration.
7-13 (e) If the registration is performed by the Department[,] or a
7-14 contracted agent issue the regular license plate or plates.
7-15 (f) If the registration is performed by a registered dealer, provide
7-16 information to the owner regarding the manner in which the regular
7-17 license plate or plates will be made available to him.
7-18 2. Upon proof of ownership satisfactory to the Director, he
7-19 shall cause to be issued a certificate of ownership as provided in this
7-20 chapter.
7-21 3. Every vehicle being registered for the first time in Nevada
7-22 must be taxed for the purposes of the governmental services tax for
7-23 a 12-month period.
7-24 4. The Department shall deduct and withhold 2 percent of the
7-25 taxes collected pursuant to paragraph (c) of subsection 1 and remit
7-26 the remainder to the Department of Taxation.
7-27 5. A registered dealer shall forward all fees and taxes collected
7-28 for the registration of vehicles to the Department.
7-29 6. Except with respect to a fee authorized by subsection 3 of
7-30 section 3 of this act, a contracted agent shall transmit all fees and
7-31 taxes collected for the registration of vehicles to the Department,
7-32 as required pursuant to paragraph (b) of subsection 2 of that
7-33 section.
7-34 Sec. 14. NRS 482.280 is hereby amended to read as follows:
7-35 482.280 1. The registration of every vehicle expires at
7-36 midnight on the day specified on the receipt of registration, unless
7-37 the day specified falls on a Saturday, Sunday or legal holiday. If the
7-38 day specified on the receipt of registration is a Saturday, Sunday or
7-39 legal holiday, the registration of the vehicle expires at midnight on
7-40 the next judicial day. The Department shall mail to each holder of a
7-41 certificate of registration an application for renewal of registration
7-42 for the following period of registration. The applications must be
7-43 mailed by the Department in sufficient time to allow all applicants
7-44 to mail the applications to the Department and to receive new
7-45 certificates of registration and license plates, stickers, tabs or other
8-1 suitable devices by mail before the expiration of their registrations.
8-2 An applicant may present or submit the application to any agent or
8-3 office of the Department[.] or a contracted agent.
8-4 2. An application:
8-5 (a) Mailed or presented to the Department or to a county
8-6 assessor pursuant to the provisions of this section;
8-7 (b) Submitted to the Department pursuant to NRS 482.294; [or]
8-8 (c) Presented to an authorized inspection station or authorized
8-9 station pursuant to the provisions of NRS 482.281[,] ; or
8-10 (d) Presented to a contracted agent pursuant to the provisions
8-11 of section 3 of this act,
8-12 must include, if required, evidence of compliance with standards for
8-13 control of emissions.
8-14 3. The Department shall insert in each application mailed
8-15 pursuant to subsection 1:
8-16 (a) The amount of the governmental services tax to be collected
8-17 for the county pursuant to the provisions of NRS 482.260.
8-18 (b) The amount set forth in a notice of nonpayment filed with
8-19 the Department by a local authority pursuant to NRS 484.444.
8-20 (c) A statement which informs the applicant that, pursuant to
8-21 NRS 485.185, he is legally required to maintain insurance during
8-22 the period in which the motor vehicle is registered.
8-23 4. An owner who has made proper application for renewal of
8-24 registration before the expiration of the current registration but who
8-25 has not received the license plate or plates or card of registration for
8-26 the ensuing period of registration is entitled to operate or permit the
8-27 operation of that vehicle upon the highways upon displaying thereon
8-28 the license plate or plates issued for the preceding period of
8-29 registration for such a time as may be prescribed by the Department
8-30 as it may find necessary for the issuance of the new plate or plates
8-31 or card of registration.
8-32 Sec. 15. NRS 482.2805 is hereby amended to read as follows:
8-33 482.2805 1. Except as otherwise provided in subsection 3,
8-34 the Department or a contracted agent shall not renew the
8-35 registration of a motor vehicle if a local authority has filed with the
8-36 Department a notice of nonpayment pursuant to NRS 484.444
8-37 unless, at the time for renewal of the registration, the registered
8-38 owner of the motor vehicle provides to the Department or
8-39 contracted agent a receipt issued by the local authority pursuant to
8-40 NRS 482.2807.
8-41 2. If the registered owner provides a receipt to the Department
8-42 or contracted agent pursuant to subsection 1 and complies with the
8-43 other requirements of this chapter, the Department or contracted
8-44 agent shall renew the registration of the motor vehicle.
9-1 3. The Department or contracted agent shall renew the
9-2 registration of a motor vehicle owned by a short-term lessor for
9-3 which the Department has received a notice of nonpayment pursuant
9-4 to NRS 484.444 without requiring the short-term lessor to provide a
9-5 receipt pursuant to subsection 1 if the short‑term lessor submits to
9-6 the Department or contracted agent a certificate issued by a local
9-7 authority pursuant to subsection 4.
9-8 4. A local authority shall, upon request, issue to a short-term
9-9 lessor a certificate which requires the Department or contracted
9-10 agent to renew the registration of a motor vehicle owned by the
9-11 short-term lessor without requiring the short-term lessor to provide a
9-12 receipt pursuant to subsection 1 if the short-term lessor provides the
9-13 local authority with the name, address and number of the driver’s
9-14 license of the short-term lessee who was leasing the vehicle at the
9-15 time of the violation.
9-16 5. Upon the request of the registered owner of a motor vehicle,
9-17 the Department shall provide a copy of the notice of nonpayment
9-18 filed with the Department by the local agency pursuant to
9-19 NRS 484.444.
9-20 6. If the registration of a motor vehicle that is identified in a
9-21 notice of nonpayment filed with the Department by a local authority
9-22 pursuant to NRS 484.444 is not renewed for two consecutive
9-23 periods of registration, the Department shall delete any records
9-24 maintained by the Department concerning that notice.
9-25 7. The Department may require a local authority to pay a fee
9-26 for the creation, maintenance or revision of a record of the
9-27 Department concerning a notice of nonpayment filed with
9-28 the Department by the local authority pursuant to NRS 484.444. The
9-29 Department shall, by regulation, establish any fee required by this
9-30 subsection. Any fees collected by the Department pursuant to this
9-31 subsection must be:
9-32 (a) Deposited with the State Treasurer for credit to the Motor
9-33 Vehicle Fund; and
9-34 (b) Allocated to the Department to defray the cost of carrying
9-35 out the provisions of this section.
9-36 Sec. 16. NRS 482.285 is hereby amended to read as follows:
9-37 482.285 1. If any certificate of registration or certificate of
9-38 ownership is lost, mutilated or illegible, the person to whom it was
9-39 issued shall immediately make application for and obtain a duplicate
9-40 or substitute therefor upon furnishing information satisfactory to the
9-41 Department and upon payment of the required fees.
9-42 2. If any license plate or plates or any decal is lost, mutilated or
9-43 illegible, the person to whom it was issued shall immediately make
9-44 application for and obtain a duplicate or substitute therefor upon:
9-45 (a) Furnishing information satisfactory to the Department; and
10-1 (b) Payment of the fees required by NRS 482.500.
10-2 3. The Department or a contracted agent shall issue duplicate
10-3 or substitute plates if the applicant:
10-4 (a) Returns the mutilated or illegible plates to the Department or
10-5 contracted agent or certifies under oath that the plates were lost or
10-6 stolen; and
10-7 (b) Makes application for renewal of registration. Credit must be
10-8 allowed for the portion of the registration fee and governmental
10-9 services tax attributable to the remainder of the current registration
10-10 period.
10-11 Sec. 17. NRS 482.292 is hereby amended to read as follows:
10-12 482.292 As used in this section and NRS 482.293 and 482.294,
10-13 unless the context otherwise requires, “document” means an
10-14 application, notice, report, statement or other record relating to the
10-15 issuance or renewal of a certificate of registration, or the issuance of
10-16 a certificate of ownership pursuant to this chapter by financial
10-17 institutions, new vehicle dealers , [and] used vehicle dealers and
10-18 contracted agents on behalf of their customers.
10-19 Sec. 18. NRS 482.295 is hereby amended to read as follows:
10-20 482.295 The Department , [or] a registered dealer [shall] or
10-21 contracted agent may not register a vehicle intended to be leased by
10-22 a short-term lessor until the owner demonstrates to the Department
10-23 his financial ability to respond to damages by providing evidence of
10-24 insurance as that term is defined in NRS 485.034.
10-25 Sec. 19. NRS 482.399 is hereby amended to read as follows:
10-26 482.399 1. Upon the transfer of the ownership of or interest
10-27 in any vehicle by any holder of a valid registration, or upon
10-28 destruction of the vehicle, the registration expires.
10-29 2. The holder of the original registration may transfer the
10-30 registration to another vehicle to be registered by him and use the
10-31 same license plate or plates thereon, if the license plate or plates are
10-32 appropriate for the second vehicle, upon filing an application for
10-33 transfer of registration and upon paying the transfer registration fee
10-34 and the excess, if any, of the registration fee and governmental
10-35 services tax on the vehicle to which the registration is transferred
10-36 over the total registration fee and governmental services tax paid on
10-37 all vehicles from which he is transferring his ownership or interest.
10-38 Except as otherwise provided in NRS 482.294, an application for
10-39 transfer of registration must be made in person, if practicable, to any
10-40 office or agent of the Department , [or to] a registered dealer[,] or
10-41 contracted agent, and the license plate or plates may not be used
10-42 upon a second vehicle until registration of that vehicle is complete.
10-43 In computing the governmental services tax, the Department, its
10-44 agent , [or] the registered dealer or contracted agent shall credit the
10-45 portion of the tax paid on the first vehicle attributable to the
11-1 remainder of the current registration period or calendar year on a pro
11-2 rata monthly basis against the tax due on the second vehicle or on
11-3 any other vehicle of which the person is the registered owner. If any
11-4 person transfers his ownership or interest in two or more vehicles,
11-5 the Department , [or] the registered dealer or contracted agent shall
11-6 credit the portion of the tax paid on all of the vehicles attributable to
11-7 the remainder of the current registration period or calendar year on a
11-8 pro rata monthly basis against the tax due on the vehicle to which
11-9 the registration is transferred or on any other vehicle of which the
11-10 person is the registered owner. The certificates of registration and
11-11 unused license plates of the vehicles from which a person transfers
11-12 his ownership or interest must be submitted before credit is given
11-13 against the tax due on the vehicle to which the registration is
11-14 transferred or on any other vehicle of which the person is the
11-15 registered owner.
11-16 3. In computing the registration fee, the Department or its
11-17 agent , [or] the registered dealer or contracted agent shall credit the
11-18 portion of the registration fee paid on each vehicle attributable to the
11-19 remainder of the current calendar year or registration period on a pro
11-20 rata basis against the registration fee due on the vehicle to which
11-21 registration is transferred. If the amount owed on the registration fee
11-22 or governmental services tax on that vehicle is less than the credit
11-23 on the total registration fee or governmental services tax paid on all
11-24 vehicles from which a person transfers his ownership or interest, the
11-25 Department shall issue to the person a refund in an amount equal to
11-26 the difference between the amount owed on the registration fee or
11-27 governmental services tax on that vehicle and the credit on the total
11-28 registration fee or governmental services tax paid on all vehicles
11-29 from which a person transfers his ownership or interest.
11-30 4. If the license plate or plates are not appropriate for the
11-31 second vehicle, the plate or plates must be surrendered to the
11-32 Department , [or] registered dealer or contracted agent and an
11-33 appropriate plate or plates must be issued by the Department. The
11-34 Department shall not reissue the surrendered plate or plates until the
11-35 next succeeding licensing period.
11-36 5. If application for transfer of registration is not made within
11-37 60 days after the destruction or transfer of ownership of or interest
11-38 in any vehicle, the license plate or plates must be surrendered to the
11-39 Department on or before the 60th day for cancellation of the
11-40 registration.
11-41 6. If a person cancels his registration and surrenders to the
11-42 Department his license plates for a vehicle, the Department shall
11-43 issue to the person a refund of the portion of the registration fee and
11-44 governmental services tax paid on the vehicle attributable to the
12-1 remainder of the current calendar year or registration period on a pro
12-2 rata basis.
12-3 Sec. 20. This act becomes effective on July 1, 2003.
