AN ACT making an appropriation to the Legislative Committee on Public Lands for a study to determine the feasibility of rehabilitating the Bishop Creek Dam in Elko County; and providing other matters properly relating thereto.
THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN
SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:
1-1 Section 1. 1. There is hereby appropriated from the State
1-2 General Fund to the Legislative Committee on Public Lands created
1-3 by NRS 218.5363 the sum of $15,000 to contract with a qualified
1-4 entity to study the feasibility of renovating or reconstructing a dam
1-5 at the Bishop Creek Dam Site in Elko County.
1-6 2. The study must include:
1-7 (a) An analysis of the availability of water rights to provide
1-8 water to fill and operate a dam at the site efficiently without causing
1-9 conflicts with other existing water rights;
1-10 (b) An analysis of the cost of constructing a road to provide
1-11 access for construction equipment, materials and labor to renovate
1-12 or reconstruct a dam at the site; and
1-13 (c) A survey of the amount and location of public access that
1-14 would be available to the reservoir if a dam were renovated or
1-15 reconstructed at the site.
2-1 Sec. 2. Any remaining balance of the appropriation made by
2-2 section 1 of this act must not be committed for expenditure after
2-3 June 30, 2005, and reverts to the State General Fund as soon as all
2-4 payments of money committed have been made.
2-5 Sec. 3. This act becomes effective on July 1, 2003.
2-6 H
