AN ACT relating to writs of prohibition; revising the provisions governing the issuance of writs of prohibition to conform to the Nevada Constitution by providing that a district court may issue a writ of prohibition in certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 34.330 is hereby amended to read as follows:

1-2  34.330  The writ may be issued only by the Supreme Court or a

1-3  district court to an inferior tribunal, or to a corporation, board or

1-4  person, in all cases where there is not a plain, speedy and adequate

1-5  remedy in the ordinary course of law. It is issued upon affidavit, on

1-6  the application of the person beneficially interested.

1-7  Sec. 2.  This act becomes effective upon passage and approval.
