AN ACT making an appropriation to the Interim Finance Committee for allocation to the Department of Public Safety for radio system costs, infrastructure upgrades and user equipment; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. There is hereby appropriated from the State

1-2  Highway Fund the sum of $14,656,066 and from the State General

1-3  Fund the sum of $1,800,000 to the Interim Finance Committee for

1-4  allocation to the Department of Public Safety for radio system costs,

1-5  infrastructure upgrades and user equipment.

1-6  Sec. 2.  1.  The Department of Public Safety shall submit a

1-7  request to the State Board of Examiners for an allocation by the

1-8  Interim Finance Committee of the money appropriated by section 1

1-9  of this act.

1-10      2.  The State Board of Examiners shall consider the request,

1-11  may require such additional information as they deem appropriate

1-12  and shall, if it finds that an allocation should be made, recommend

1-13  the amount of the allocation to the Interim Finance Committee for

1-14  its independent evaluation and action. The Interim Finance


2-1  Committee is not bound to follow the recommendation of the State

2-2  Board of Examiners.

2-3  3.  If the Interim Finance Committee, after independent

2-4  determination, finds that an allocation recommended by the State

2-5  Board of Examiners should and may lawfully be made, the

2-6  Committee shall by resolution establish the amount and purpose of

2-7  the allocation, and direct the State Controller to transfer that amount

2-8  to the appropriate fund and account. The State Controller shall

2-9  thereupon make the transfer.

2-10      Sec. 3.  The sums appropriated by section 1 of this act are

2-11  available for either fiscal year. Any remaining balance of the sums

2-12  appropriated by section 1 of this act must not be allocated by the

2-13  Interim Finance Committee after June 30, 2005, and reverts to the

2-14  State Highway Fund and to the State General Fund, respectively, as

2-15  soon as all payments of money committed have been made.

2-16      Sec. 4.  This act becomes effective July 1, 2003.
