AN ACT making appropriations to the Interim Finance Committee for allocation to state entities for radio system costs, infrastructure upgrades and user equipment; additionally making available for such purposes certain funds in the forfeiture accounts administered by the State Treasurer; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. 1.  There is hereby appropriated from the State

1-2  Highway Fund the sum of $14,656,066 to the Interim Finance

1-3  Committee for allocation to state entities that receive appropriations

1-4  or authorizations from the State Highway Fund for radio system

1-5  costs, infrastructure upgrades and user equipment.

1-6  2.  There is hereby appropriated from the State General Fund

1-7  the sum of $1,500,000 to the Interim Finance Committee for

1-8  allocation to state entities that receive appropriations or

1-9  authorizations from the State General Fund for radio system costs,

1-10  infrastructure upgrades and user equipment.

1-11      Sec. 2.  In addition to the sum made available for allocation

1-12  pursuant to subsection 2 of section 1 of this act, the Interim Finance

1-13  Committee is hereby authorized, for the purpose of assisting the


2-1  state entities described in that subsection, to expend for allocation

2-2  pursuant to section 3 of this act:

2-3  1.  Three hundred thousand dollars from the forfeiture accounts

2-4  administered by the State Treasurer pursuant to NRS 179.1187; and

2-5  2.  Such additional amounts from the forfeiture accounts

2-6  administered by the State Treasurer pursuant to NRS 178.1187 as

2-7  may be available in those accounts on or before June 30, 2005.

2-8  Sec. 3.  1.  A state entity may submit a request to the State

2-9  Board of Examiners for an allocation by the Interim Finance

2-10  Committee of the money:

2-11      (a) Appropriated by section 1 of this act; and

2-12      (b) If the state entity is a state entity described in subsection 2 of

2-13  section 1 of this act, authorized for expenditure pursuant to section 2

2-14  of this act.

2-15      2.  The State Board of Examiners shall consider the request,

2-16  may require such additional information as they deem appropriate

2-17  and shall, if it finds that an allocation should be made, recommend

2-18  the amount of the allocation to the Interim Finance Committee for

2-19  its independent evaluation and action. The Interim Finance

2-20  Committee is not bound to follow the recommendation of the State

2-21  Board of Examiners.

2-22      3.  If the Interim Finance Committee, after independent

2-23  determination, finds that an allocation recommended by the State

2-24  Board of Examiners should and may lawfully be made, the

2-25  Committee shall by resolution establish the amount and purpose of

2-26  the allocation, and direct the State Controller to transfer that amount

2-27  to the appropriate fund and account. The State Controller shall

2-28  thereupon make the transfer.

2-29      4.  With respect to the state entities described in subsection 2 of

2-30  section 1 of this act:

2-31      (a) The State Board of Examiners and the Interim Finance

2-32  Committee shall, in determining whether an allocation should be

2-33  made from the sum appropriated pursuant to that subsection,

2-34  consider whether additional money is available for use from the

2-35  forfeiture accounts administered by the State Treasurer pursuant to

2-36  NRS 179.1187.

2-37      (b) The Interim Finance Committee shall, in granting allocations

2-38  to such state entities, apply the following preference:

2-39          (1) To first pay for such allocations from the proceeds

2-40  available from the forfeiture accounts administered by the State

2-41  Treasurer pursuant to NRS 179.1187; and

2-42          (2) To pay for such allocations secondarily by using the

2-43  proceeds appropriated from the State General Fund as described in

2-44  subsection 2 of section 1 of this act.


3-1  Sec. 4.  The sums appropriated by section 1 of this act are

3-2  available for either fiscal year. Any remaining balance of the sums

3-3  appropriated by section 1 of this act must not be allocated by the

3-4  Interim Finance Committee after June 30, 2005, and reverts to the

3-5  State Highway Fund and to the State General Fund, respectively, as

3-6  soon as all payments of money committed have been made.

3-7  Sec. 5.  This act becomes effective July 1, 2003.
