AN ACT relating to public officers; increasing the compensation of district attorneys and sheriffs; authorizing a county to request and receive a waiver from the increases in compensation in the event of insufficient financial resources; providing that a waiver may not be applied for in certain circumstances; and providing other matters properly relating thereto.

 

THE PEOPLE OF THE STATE OF NEVADA, REPRESENTED IN

SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS:

 

1-1  Section 1. NRS 245.043 is hereby amended to read as follows:

1-2  245.043  1.  As used in this section:

1-3  (a) “County” includes Carson City.

1-4  (b) “County commissioner” includes the Mayor and supervisors

1-5  of Carson City.

1-6  2.  Except as otherwise provided by any special law, the elected

1-7  officers of the counties of this state are entitled to receive annual

1-8  salaries in the base amounts specified in the following table. The

1-9  annual salaries are in full payment for all services required by law to

1-10  be performed by such officers. Except as otherwise provided by law,

1-11  all fees and commissions collected by such officers in the

1-12  performance of their duties must be paid into the county treasury

1-13  each month without deduction of any nature.

4-4  Sec. 3. Except as otherwise provided in section 4 of this act,

4-5  each county shall:

4-6  1.  Commence payment of the increased annual salaries of the

4-7  elected officers of the county set forth in the table of annual salaries

4-8  contained in NRS 245.043, as amended by section 1 of this act, on

4-9  July 1, 2003.

4-10      2.  Commence payment of the increased annual salaries of the

4-11  elected officers of the county set forth in the table of annual salaries

4-12  contained in NRS 245.043, as amended by section 2 of this act, on

4-13  July 1, 2004.

4-14      Sec. 4. 1.  Except as otherwise provided in subsection 3, a

4-15  board of county commissioners may apply to the Committee on

4-16  Local Government Finance for a waiver from:

4-17      (a) The requirement to increase the annual salaries of elected

4-18  officers of the county to the annual salaries set forth in the table

4-19  contained in NRS 245.043, as amended by section 1 of this act, if

4-20  the board determines that the financial resources of the county are

4-21  insufficient to pay those increased annual salaries in Fiscal Year

4-22  2003-2004.

4-23      (b) The requirement to increase the annual salaries of elected

4-24  officers of the county to the annual salaries set forth in the table

4-25  contained in NRS 245.043, as amended by section 2 of this act, if

4-26  the board determines that the financial resources of the county are

4-27  insufficient to pay those increased annual salaries in Fiscal Year

4-28  2004-2005.

4-29  The Committee on Local Government Finance shall grant such a

4-30  waiver if it finds that the financial resources of the county are

4-31  insufficient to pay those increased annual salaries in the applicable

4-32  fiscal year.

4-33      2.  A board of county commissioners that has been granted a

4-34  waiver for a fiscal year may apply to the Committee on Local

4-35  Government Finance for an additional waiver for the next

4-36  consecutive fiscal year if it finds that the financial resources of the

4-37  county continue to be insufficient to pay the increased annual

4-38  salaries of the elected officers of the county set forth in the table

4-39  contained in NRS 245.043, as amended by section 1 or 2 of this act.

4-40  There is no limitation on the number of waivers for consecutive

4-41  fiscal years that the board of county commissioners may be granted

4-42  if the board of county commissioners finds that the financial

4-43  resources of the county continue to be insufficient to pay the

4-44  increased annual salaries of the elected officers of the county set


5-1  forth in the table contained in NRS 245.043, as amended by section

5-2  1 or 2 of this act, in that fiscal year.

5-3  3.  Except as otherwise provided in this subsection, after

5-4  commencing payment of the increased annual salaries of the elected

5-5  officers of the county set forth in the table contained in NRS

5-6  245.043, as amended by section 1 or 2 of this act, a board of county

5-7  commissioners may not apply for a waiver in any subsequent fiscal

5-8  year. The fact that a board of county commissioners has, in Fiscal

5-9  Year 2003-2004, paid the annual salaries set forth in the table

5-10  contained in NRS 245.043 as amended by section 1 of this act, does

5-11  not preclude the board of county commissioners from applying for

5-12  and being granted a waiver from paying the annual salaries set forth

5-13  in the table contained in NRS 245.043 as amended by section 2 of

5-14  this act in Fiscal Year 2004-2005 or in any consecutive year if the

5-15  Committee on Local Government Finance determines that

5-16  the financial resources of the county are insufficient to pay the

5-17  increased annual salaries of the elected officers of the county.

5-18      4.  The increased annual salaries of the elected officers of the

5-19  county set forth in the table contained in NRS 245.043, as amended

5-20  by section 1 or 2 of this act, must not be paid retroactively for a

5-21  period to which a waiver is applicable.

5-22      Sec. 5. The provisions of NRS 354.599 do not apply to any

5-23  additional expenses of a local government that are related to the

5-24  provisions of this act.

5-25      Sec. 6. 1.  This section and sections 1, 3, 4 and 5 of this act

5-26  become effective on July 1, 2003.

5-27      2.  Section 1 of this act expires by limitation on June 30, 2004.

5-28      3.  Section 2 of this act becomes effective on July 1, 2004.
